  2. About this visa This visa subclass 309 and 100 allows the partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia. The provisional Partner Visa 309 is temporary while Partner Visa Subclass 100 is permanent. The temporary provisional 309 visa is granted first, which allows the applicant to stay in Australia for two years with their partner and apply for the permanent visa subclass 100 within that duration. You can apply both the visas together.

  4. How long you can stay • you can stay with 309 visa until they decide your permanent partner visa 100 application or you withdraw the application • this stay is from 15 to 24 months, for most of the applicants • you stay in Australia indefinitely with visa 100, this is a permanent visa

  5. How long you can stay • you become a permanent resident on the day you grant the visa 100 • For citizenship purposes, your permanent residency starts on the day visa granted if you are in Australia you enter Australia on this visa if you are outside.

  6. Include Family You can include your family members with the application when you apply for the combined temporary and permanent visas. If you have a dependent child who does not hold a visa subclass 309, you can add them to your application before making a decision on your permanent visa application. The child must hold a Dependent Child visa subclass 445.

  7. Include Family Your family members must meet the health requirement. They must also meet character requirement if they are 16 years old or older. Family members who are not applying for the visa might also need to meet the health requirement.

Processing Times • For Subclass 309: 75% of visa applications in 15 months and 90% of applications in 20 months. • For Subclass 100: 75% of applications in 14 months and 90% of visa applications in 21 months. • Your application might take longer to process if: • you do not fill the form correctly • you don't include all required documents properly • visa application can’t process if you not pay the correct charge
