The WTO accession process was a major factor in the enactment of the 2004 Customs Code. • This Code closely followed European and World Customs Organization practices. • Russian Custom’s practices became more transparent and less arbitrary. • Some provisions in this Code were intended to protect IPR and reduced clearance time to 3 days.

  4. The Customs Code is a work in progress and is regularly amended to conform to international practices some current issues under discussion are: • Ex-officio provisions for IPR protection. • Simplified procedures. • Calculation of Customs fees .

  5. If and when Russia accedes to WTO there will be some major changes to Customs Tariffs. • The average rates applicable to industrial goods will be decreased to 8% within 1-7 years, currently this rate is 10.1%. • The average rate on agricultural products will be reduced to 3%, the current rate is 9.7 %.

  6. Some special Tariff issues when Russia accedes to WTO are: • For new cars the import duty rates should be reduced to 15% within 7 years. The prohibitive rates (about 200%) on used cars will remain in effect. • The import duty rates for civil aviation equipment will be reduced from 20% to 12.5% within 7 years. • The import rates for aluminum products are planned to be reduced from 6 to 3% within 4-5 years.

  7. In addition to WTO Russian Customs has harmonized it’s practices with The World Customs Organization, TRIPS, Kyoto accords and other International agreements. It has adopted the following: • TRIPS on IPR. • The EU regulation on the Unified Administrative Document that harmonizes the Russian Customs Declaration with the EU’s. • The Russian classification system for goods is closely harmonized with International practices. This provides a strong basis for the facilitation of International Trade.

  8. While Russian Customs has accomplished a great deal in adopting International Standards implementation has a long way to go. Some current issues are: • VALUATION- issues such as Price Lists, the new Regulation on automatic valuation and court practices are currently of great interest to importers.These issues significantly impact “gray market” structures in Russia. • BORDER CROSSING PROBLEMS. • IMPLEMENTATION OF ELECTRONIC FILING PROCEDURES FOR CUSTOMS DECLARATIONS. • PROBLEMS WITH CUSTOMS CLEARANCE.

  9. Customs in Russia plays a highly influential role, shaping the conditions for Russia’s foreign economic relations. Day to day practices of customs significantly affect accessibility of Russian commodity and investment markets. Understanding of these practices will be the source of success and failure of any cross border business project.
