  3. CARACTERÍSTICAS • Personalísimo • Exclusiva de los cónyuges • A solicitud del interesado

  4. TIPOS DE DIVORCIO • Por enfermedad • Grave, incurable y/o contagiosa • Incapacidad mental • Por causales objetivas • Voluntad de los cónyuges • Por culpa • Causales de divorcio

  5. DIVORCIO VOLUNTARIO • Cualquiera de los cónyuges • Acuerdo mutuo • Repartición de bienes • Pago de alimentos • Patria potestad • Sólo puede solicitarse después de transcurrido un año de matrimonio

  6. DIVORCIO NECESARIO • Demandado por el cónyuge inocente o afectado • Puede ser demandado en cualquier tiempo no es necesario que transcurra tiempo para realizarlo

  8. No incluye: Ausencia legalmente hecha o presunción de la muerte Nueva causal: XV. Someterse uno de los cónyuges a métodos de reproducción asistida con material genético de terceros, sin consentimiento del otro. CAUSALES DE DIVORCIO ART. 156
