  5. LAND DEVELOPMENT CODE COMPLIANCEProposedDeviation/Recommendation 1. Floor Area Ratio (FAR): a. (Tract 1, 2, 7, 8) Increase maximum FAR from .40 to.50 b. (Tract 4) Hospital– Increase FAR from .40 to .75 Staff Recommendation: Approve Justification:Comprehensive Plan - Objective 1.1.2.2 Deviations from density and intensity standards may be permissible in order to promote and encourage creatively planned projects and in recognition of special geographical features, environmental conditions, economic issues, or other unique circumstances. 2. Building Height: Tract 4 (Hospital): Increase maximum building height from 100 ft. to 120 ft. - Clarified at First Reading – Maximum hospital building height is 120 feet, including mechanical equipment, communcation devices, etc. Staff Recommendation: Approve Justification:Comprehensive Plan - Objective 1.1.2.2 Deviations from density and intensity standards may be permissible in order to promote and encourage creatively planned projects and in recognition of special geographical features, environmental conditions, economic issues, or other unique circumstances. 3. Monument Signs (I-95/SR100) a.Increase maximum permitted sign area Staff Recommendation: Approve Justification: LDCChapter 12, Signs and Advertising, provides for variances of up to 25% of the maximum height or area of a sign. In question is the signage area for each of the two proposed monument signs. The sign area for each sign, as proposed, measures 102 sq. ft. versus 96 sq. ft. permitted by the LDC. Given signage geometry, location considerations, and orientation the square footage deviation of six (6) sq. ft. or 6% above the maximum sign area permitted by the LDC is deemed acceptable. 4. Electronic Message Display Sign SR100 @ Memorial Medical Parkway Staff Recommendation: Deny Justification: LDCChapter 12, Signs and Advertising, Section 12.03.02 prohibits electronic display type signs. Various studies have been conducted regarding the effect on traffic safety of electronic changeable message signs. Study results indicate these type signs create a distraction to drivers and that driver distraction continues to be a significant underlying cause of traffic accidents. The PLDRB and/or City Council is not authorized to render a determination that electronic message signs are only a safety hazard or aesthetic nuisance if such signage displays a commercial message as opposed to a quasi-government type message; they either are a traffic safety threat or they are not.

Planning and Land Development Board Recommendation (PLDRB): At the meeting of August 18, 2010 the PLDRB unanimously passed a motion recommending that City Council approve Application #1919; Rezone of Parcel ID #; 08-12-31-0650-000A0-0015; 09-12-31-0000-01070-0010 and 09-12-31-0000-02030-0020 (Florida Hospital Flagler) from General Commercial (COM-2) to Master Planned Development District (MPD) subject to deleting all references to the electronic message center from the Master Plan Development, Development Agreement.

CITY COUNCIL 1ST READING At the meeting of September 21, 2010 City Council voted 4-1 to approve Application #1919; Rezone of Parcel ID #; 08-12-31-0650-000A0-0015; 09-12-31-0000-01070-0010 and 09-12-31-0000-02030-0020 (Florida Hospital Flagler) from General Commercial (COM-2) to Master Planned Development District (MPD) subject to deleting all references to the electronic message center from the Master Plan Development, Development Agreement. Council also directed the staff and the applicant work together on potential standards.

  10. STAFF RECOMMENDATION: CITY COUNCIL 2nd Reading City Council approve Application #1919 to amend the zoning map of the subject property from COM-2 to MPD (Master Planned Development District) subject to deleting all Development Agreement references to the electronic message display sign.
