FOSC SOLICITATION Section L – Instructions • Discuss the benefits and rationale for any teaming partner(s), subcontracts or other arrangements. • Include specific detail in the following areas so that the Government can determine that the prime contractor making the offer will be performing the primary and vital requirements for the contract: • Which party will be managing the contract. • Which party possesses the requisite background and expertise to carry out the contract. • Which party pursued the contract award. • What degree of collaboration was there on the proposal. • The allocation of tasks to be performed by each party or whether there will be commingling of personnel or material. • What is the amount of work to be performed by each party (reference FAR 52.219-14, Limitation on Subcontracting). • Which party will perform the more complex and costly contract functions. • The business size of the other parties. • Which of the parties possess the qualifications relevant to the contract requirements.

FOSC SOLICITATIONSection M – Evaluation Criteria • An evaluation will be made of the overall effectiveness and efficiency of the offeror’s management approach, including: WBS and Dictionary Plan; Management Plan; Environmental Compliance Plan; customer relations; business and information systems; cost and price tracking; Project Reporting plan; Overall Program Reporting Plan; allocation of labor skills into the proposed organization; local organizational structure; corporate organizational structure, including lines of communication, local autonomy, span of control, and corporate support;benefits andrationale for any teaming partners, subcontractors, or other arrangements, and the impact, if any, on the offeror’s status as a small business; identification and mitigation of management risks; acceptance of contract terms and conditions; and Conflicts of Interest Avoidance Plan.

  4. Analysis of Data • SEB relied upon data provided by the offerors and other data available, e.g.: • Section K – Representations & Certifications • All Proposal Data • Management, Technical, Past Performance & Cost Volumes • Past Performance Information • SBA ProNet • Discussions

  5. Analysis of Data (cont.) • FAR 52.219-14 Limitation on Subcontracting • Verified that the % of work proposed to be performed met FAR 52.219-14: • (1) Services (except construction). At least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern. • SBA Seven Factors Test • As part of the initial evaluation, the SEB analyzed the data submitted and evaluated whether the offerors met the criteria for small business.
