Commercial Surrogacy is legal in India • Commercial surrogacy is legalized and is estimated to be worth more than $1bn a year in India. • The high cost of surrogacy in Europe and the US means many Western women are outsourcing pregnancy abroad. • A 2012 study by the Centre for Social Research (CSR) estimates that around 40 % of the clients are foreign couples visiting India for reproductive services and nearly 30% are single. Assisted Reproductive Technologies (ART) Regulation Bill 2010 states • Surrogates will have to be 21-35 years old and can only undergo five live births, including their own children • Surrogates will not be allowed to donate their own eggs to a couple and will forego any rights to the child. • Intended parents will have to be married and prove that surrogacy is permitted in their home country and that the baby has the right to return. • Same sex couples or Gay couples are prohibited from surrogacy as gay marriage is not recognized in India Visit: http://www.internationalfertilitycentre.com/treatments/

Laws on surrogacy around the world • The surrogate mother who gives birth to a child is considered its legal mother in Ireland and the UK. • Commercial surrogacy is not allowed in most states of Europe. • Surrogacy is illegal in Italy, Germany, France, Norway and Sweden. • In the Ukraine, as in certain states in the US and in India, commercial surrogacy has been legal since 2002.
