Considerations for Obtaining a Timely Permit: • Pre-application meetings with KDHE • Completeness of application • Timely response to agency’s comments during review • Minimal changes to application • Applicant-hosted public information meetings • Concurrent notices for public notice and public hearing • Environmental Protection Agency enforcement issues • Retaining permit engineers (salary disparity between state and private industry) Our Vision – Healthy Kansans living in safe and sustainable environments.

KDHE Steps toStreamline Permit Process • Applicant provides electronic copy of permit application and a proposed draft permit • Public notice for the draft permit and tentative public hearing is published concurrently • Informational meeting with the proposed facility to discuss project details requirements Our Vision – Healthy Kansans living in safe and sustainable environments.

BAR Permit Regulatory Timelines Regulatory timeline - 18 months after receipt of application • In accordance with Kansas Statute KSA 3008b(h)3 • Construction Permit application timeline begins when application is deemed complete • Operating Permit application must be submitted within 6 to 18 months prior to permit renewal date. Source may continue to operate if permit expires prior to renewal date Our Vision – Healthy Kansans living in safe and sustainable environments.

BAR Permit Goals • 180-days for PSD construction permits, other complex permits, & Class I operating permits • 60 days for regular construction permits and Class II operating permits • 30 days for approval construction documents • 10 days for standard construction permits/approvals and responses Our Vision – Healthy Kansans living in safe and sustainable environments.
