Facts A fifteen year old girl alleged that she was persuaded into leaving her house to meet with a person she meet through MySpace. “ Jane Doe” said that he was a sexual predator and sexually assaulted her. The plaintiff said that MySpace is not protected under the Communications Decency Acts (CDA) because they failed to provide safety measures on their website. Also that MySpace was the informer in the relationship and was providing information that led to the alleged assault. “ Jane Doe” thought that MySpace should be held liable for negligence, gross negligence, and strict product liability. MySpace dismissed the complaint.

  3. Decision MySpace was not responsible for the mans actions. The CDA even said that “No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.” MySpace isn’t an content provider, it is just a provider for people to share their own information at their own will.
