  4. Death Row Facts In 1999, the TDCJ moved Death Row to the Polunsky Unit. The Polunsky Unit houses Death Row offenders separately in single-person cells measuring 60 square feet, with each cell having a window.  Death Row offenders are also recreated individually. Offenders on Death Row receive a regular diet; have access to reading, writing, and legal materials. Depending upon their custody , some Death Row offenders are allowed to have a radio.  The women on Death Row are housed at the Mountain View Unit.  Offenders on Death Row do not have regular TDCJ-ID numbers, but have special Death Row numbers.

  5. Texas Capital Offenses • murder of a public safety officer or firefighter • murder during the commission of kidnapping, burglary, robbery, aggravated sexual assault, arson, or obstruction or retaliation • murder for remuneration (money) • murder during prison escape • murder of a correctional employee • murder by a state prison inmate who is serving a life sentence for any of five offenses (murder, capital murder, aggravated kidnapping, aggravated sexual assault, or aggravated robbery) • multiple murders • murder of an individual under six years of age

  6. Law of Parties Section 7.02 of the Texas Penal Code outlines the following: A person is criminally responsible for an offense committed by the conduct of another if "acting with intent to promote or assist the commission of the offense he solicits, encourages, directs, aids or attempts to aid the other persons to commit the offense" or "If, in the attempt to carry out a conspiracy to commit one felony, another felony is committed by one of the

  7. conspirators, all conspirators are guilty of the felony actually committed, though having no intent to commit it, if the offense was committed in furtherance of the unlawful purpose and was one that should have been anticipated as a result of the carrying out of the conspiracy.“

  8. Do not be misled: “Bad company corrupts good character.” (1 Corinthians 15:33)

  11. Summary of Incident On 02/15/98, Hall and one co-defendant abducted a 19-year old white female from a public street and drove her to a remote location. Hall and the co-defendant shot the victim several times with a pellet pistol and several times with a .22-caliber pistol. They were caught at the border when they were attempting to leave the state.

  12. Last Statement: First of all I would like to give my sincere apology to Amy's family. We caused a lot of heartache, grief, pain and suffering, and I am sorry. I know it won't bring her back. I would like to sing, I would like to sing for that person's dead. The old is gone. I am not the same person that I used to be, that person is dead. It's up to you if you would find it in your heart to forgive. As for my family, I am sorry I let you down. I caused a lot of heartache, and I ask for your forgiveness. I am not crying for myself, I am crying for the lost and those that are dying for their sins, those that are committing suicide, those that don't know God and have never been set free. I've been locked up 13 years. I am not locked up inside, all of these years I have been free. Christ has changed me. Even though I have to die for my mistake, he paid for mine by wages I could never pay. Here I am a big strong youngster, crying like a baby. I am man enough to show my emotions and I am sorry. I am sorry for everything. I wish I could take it back, but I can't.

  13. Summary of Incident On 02/20/2002, in Houston, Texas, Adams shot his 19 month old black male child twice in the chest, resulting in his death

  14. Summary of Incident On 04/01/99, during the daytime, at TDCJ-ID Telford Unit dayroom, Taylor fatally stabbed an adult black male offender multiple times with an 8" home-made weapon. Taylor and one co-defendant had engaged in a fight with the victim due to racial tension between Taylor and the victim. Taylor was a member of the Aryan Brotherhood of Texas (a recognized security threat group).

  15. Summary of Incident On 12/15/98, at approximately 8:30 a.m., Mathis shot three victims in the head with a .45 caliber pistol at a known drug house in Fort Bend County, Texas. One of the victims, a 15-year-old Hispanic female survived the shooting, paralyzed from the chest down. Mathis reportedly turned the gun on two other intended victims, however, when he attempted to pull the trigger, the gun either misfired or had been jammed.

  16. Last Statement: Yes, sir. I just want to say to all my supporters, family and friends; I love y'all and appreciate y'all. To the ones representing me today, thank you for everything. The system has failed me. This is a miscarriage of justice. There are people on death row that need help. I love my family. I love you too, Mom. I am alright. I asked the Lord to have mercy on me and I hope He has mercy on these people carrying out this mass slaughter. They have no respect for humanity. To Melanie, I never meant to hurt you. You were just in the wrong place at the wrong time. I am not asking for your forgiveness. All I have to worry about is God forgiving me. I hope you get better and for the doctors to continue to take care of you. Take care of my mother for me. To everybody, know that I love you and I am OK. Lord, have mercy on my soul. Lord, have mercy on my soul. Lord, have mercy on these peoples' soul. Life is not supposed to end this way. No more pain and frustration. When I knock at the gates, they will open up and let me in. To my mom and everybody, I love you. I can feel it right now. My life, my life.
