PROCEEDURE ON SOLEMNISATION OF MARRIAGES MARRIAGE ACT CAP 50
INTRODUCTION INTRODUCTION The Marriage Act of the laws of Zambia is currently the piece of legislation that prescribes the conduct of marriages in Zambia. Kalabo Town Council, like any other council in Zambia, is charged with the function of Registration of Marriages in the district on behalf of the Registrar-General of Marriages appointed by the Minister under the provisions of Section 4 of the Marriage Act.
Cont Cont… … The Council Secretary by virtue of his office is the Registrar of the district charged with the mandate to solemnise marriages. But he may nominate officers to act on his behalf as registrars, and the same shall be recommended to the Minister so that they are gazetted.
NOTICE OF NOTICE OF MARRIAGE MARRIAGE Persons intending to marry under this provision should give a minimum of twenty-one (21) days’ notice to the Registrar of Marriages in the district before solemnization of marriage.
REGISTRATION OF REGISTRATION OF MARRIAGE MARRIAGE After the expiration of twenty-one (21) days and before the expiration of three (03) months from the date of the notice, and upon payment of the prescribed fees, the Registrar shall issue his certificate in the prescribed form.
Cont… If for any reasons persons intending to marry are unable to give notice of twenty-one (21) days or more, the Registrar, may, if he shall think fit dispense with the giving of notice and with the issue of the certificate of the Registrar and may, upon payment of the prescribed fee, grant a special license.
Cont… ■ Persons below the age of twenty-one (21) are required to obtain a written consent (letter) from their parents or guardians. ■ Persons who are divorced are required to produce the “Divorce Certificate”. ■ Persons below the age of sixteen are required to obtain consent from a Judge of the High Court.
Cont… Duly completed Application Forms should be accompanied with the following documents:- ■ Photocopy of the receipt showing payment made to Licensing unit. ■ Photocopy of NRC, Passport or Driving license for the man or woman intending to marry. ■ Letter from the parents/guardians giving consent to the marriage, if below the age of twenty-one (21) years. ■ Copy of the Divorce Certificate, if divorced.
APPLICATION FOR SPECIAL APPLICATION FOR SPECIAL LICENSE LICENSE Persons who intend to marry outside the Civic Centre or place of worship are required to apply for issuance of a special license by the Council Secretary in accordance with the provisions of section 12 of the Marriage Act by clearly stating the venue, date, time and the minister of religion assigned to solemnise the marriage. If no minister has been engaged state the services to be provided by the registrar at the Council.
GAZETTING GAZETTING ■ The church administration is required to apply to the Council Secretary for gazetting of a place for purposes of solemnising marriages. ■ The church administration is also required to apply to the Council Secretary for gazetting of a minister recommended for purposes of solemnising marriages in Zambia by attaching copies of the curriculum vitae, academic qualifications, NRC and Ordination Certificate.
Cont… ■ The Council Secretary will in turn write to Government Printers requesting for gazetting of a place of worship or minister of a church.
CUSTOMARY MARRIAGE CUSTOMARY MARRIAGE Couples intending to obtain this certificate should come with at representative of the wife. A nominal fee of K100.00 shall be charged to obtain a Customary Marriage Certificate. least one elderly
LEGALISATION OF MARRIAGES LEGALISATION OF MARRIAGES Couples who are already married and intend to legalize their marriages can still be granted the certificate of their choice, as long as the above stated requisites are met.
