WASHINGTON WATER LAW Washington Water Code of 1917 Required individuals to file application for a permit for new surface water rights Did not affect existing water rights Groundwater Code of 1945 Established the same permitting process used for surface water Allowed for exemption to a permit of uses less than 5,000 gallons per day

  4. WASHINGTON WATER LAW Water Right – issued for a “Beneficial Use” Senior Water Right: entitled to full exercise of their allocated “right”. Set with a priority date. Junior Water Right: conditioned to a senior water right, issued after code, and assigned a priority date Classifications: Claim: initiated before the appropriate water code (surface-1917, groundwater-1945). Certificate: use issued by Ecology after code was adopted. Permit: use of water granted by Ecology, but not certificated.
