CONCORSO DEL FATTO COLPOSO DEL CREDITORE (DANNEGGIATO) • Art. 1227 comma 1: contribuzione al verificarsi del danno: diminuzione secondo la gravità della colpa e l’entità delle conseguenze • Art. 1227 comma 2: danneggiato NON partecipa alla produzione dell’evento dannoso, ma poteva evitare l’aggravarsi delle conseguenze: esclusione del risarcimento di quelle evitabili secondo l’ordinaria diligenza

SS.UU. 21/11/2011 n.24406 • Ai fini dell’art. 1227 comma 1 c.c., sussiste il comportamento omissivo colposo del danneggiato ogni qual volta tale inerzia contraria a diligenza, a prescindere dalla violazione di un obbligo giuridico di attivarsi, abbia concorso a produrre l’evento lesivo in suo danno.
