AUTHORITY FOR A MILLAGE INCREASE
  • Subsection (2) of Section 1011.73, Florida Statutes (2009) as revised by Chapter 2010-154, Laws of Florida, provides in pertinent part that:

  • MILLAGE AUTHORIZED NOT TO EXCEED 4 YEARS. The district school board, pursuant to resolution adopted at a regular meeting, shall direct the county commissioners to call an election at which the electors within the school district may approve an ad valorem tax millage as authorized under s. 1011.71(9).

AUTHORITY FOR A MILLAGE INCREASE
  • Election cannot be held more than once in any 12-month period.
  • Any millage increase cannot be levied for a period longer than 4 years.
  • District is responsible for providing ballot language that conforms to Florida law

  • B. Subsection (1) of Section 101.161, Florida Statutes provides the ballot language requirements which include:
      • Clear and unambiguous language, with an explanation in 75 words or less
      • A ballot title with 15 words or less
      • Placement on the ballot after the list of candidates

ELECTION EXPENSES

Subsection (7) of Section 1011.73, Florida Statutes (2000) provides that:

The cost of the publication of the notice of the

election and all expenses of the election

shall be paid by the district school board.

However, because this proposal will be included in the 2010 General Election the OCPS will not incur any costs associated with a special election.

AD Valorem Millage Election

BALLOT QUESTION: Shall the Orange County School district ad valorem millage be increased by a total of one mill for essential operating expenses in order to preserve academic programs, retain highly qualified teachers and protect arts, athletics and student activities beginning July 1, 2011, and ending four (4) fiscal years later on June 30, 2015, with annual reporting to ensure proper fiscal stewardship of these funds to the citizens of Orange County?
