  3. Different Categories of Green Cards

  4. Self-Sponsored • In the Ron Klasko talk on November 2nd, he mentioned “self petition” LPR such as EB-1 Extraordinary Ability and EB-2 National Interest Waiver • These Legal Permanent Residency (LPR) categories are not processed by Yale, and do not need any special OISS permission. YaleOffice of International Students and Scholars

Employment Based LPR • Employment based Legal Permanent Residency (LPR / green card) for researchers at Yale is normally prepared and submitted by the Office of International Students and Scholars (OISS) • In some cases the OISS may grant permission for Yale researchers to use an outside lawyer for the employment based LPR

  6. LPR Categories Used by Yale • First Preference (EB-1) • Aliens with extraordinary ability • Outstanding professors and researchers – For Permanent Employees (or indefinite appointment, such as Associate Research Scientist) • Certain multinational executives and managers • Second Preference (EB-2) • Members of the professions holding advanced degrees – For Ladder-Track Teaching Faculty • Aliens of exceptional ability • National Interest Waiver • Third Preference (EB-3) • Professionals and skilled workers • Other workers • Fourth Preference (EB-4): Certain special immigrations • Fifth Preference (EB-5): Investors in commercial enterprises

Yale Sponsorship • To qualify for EB-1, Yale researcher must have at least Associate Research Scientist (ARS) appointment • The Department PI must support LPR and sign a statement confirming long-term financial ability sponsorship (see Request Form on web) • Currently there is a back-log of about 40 ARS cases who have requested sponsorship • Some new ARS appointments may have to wait for OISS sponsorship, or request permission to use an outside lawyer

Requesting LPR Sponsorship Review information on web (need Yale Net ID to log-in) http://www.yale.edu/oiss/immigration/pr/index.html • If you believe you qualify, complete Request form and submit to OISS for review • OISS reviews requests considering the following • How strong an EB-1 case it is • How urgent the immigration need is (no other visa option) • Teaching faculty take priority YaleOffice of International Students and Scholars

Basic Steps Once OISS Agrees to Sponsorship • OISS gives time frame when process will start based on volume of other Yale cases, and urgency of immigration need • Preparation begins (researcher), OISS guides applicant on how to prepare evidences • OISS prepares final application, discuss Adjustment of Status • OISS send application to immigration USCIS YaleOffice of International Students and Scholars

  14. Processing Time EB-1B I-140 Application Times vary depending on: • Preparation time can take many months • USCIS internal processing issues • Use of $1,000 Premium Processing • Once application submitted to USCIS: • 5-10 months for I-140 Approval
