The Clerk and the Board • The Clerk of the Board is appointed each year by the Board of Trustees at the annual meeting. • The Clerk assists with the documents that the Trustees will review and/or take action on during regular or special meetings. • The Clerk conducts the official correspondence for the Board, executes contracts as authorized, and performs all other duties prescribed by the Board and the Superintendent. • The Clerk may be placed under a fidelity bond if the Board deems it prudent to do so.

  3. The Legal Record • One of the most important duties of the Clerk is to keep a concise and clear record of activities and actions at Board meetings. • The approved minutes of the Board are part of the legal, permanent record for the district. Handwritten notes do not have to be kept after the minutes are transcribed into the official format. • The Clerk’s meeting notices, legal advertisements and transcription of all other Board proceedings are part of the legal record. Any document that is signed by any or all Board members is part of the legal record.

  4. The Clerk and Idaho Code • The Clerk’s duties are defined in Idaho Code §33-508. • The Clerk utilizes Idaho Code to ensure that legal requirements are being met for record keeping and procedures. Following the Open Meeting Law is especially crucial for any Board meeting. • The Clerk may utilize Idaho Code to assist in the development and revision of Board policy. • The Clerk keeps apprised of changes in current law that may affect the Board and the School District.

  5. The Clerk as Board Ambassador • The Clerk provides a variety of services in conjunction with Board duties. Contact with the public may be in person, on the telephone, or by e-mail. The Clerk represents the Board and the School Administration in a positive, professional way. • The Clerk provides the public reasonable access to Board meeting minutes, and policy and legal documents that are part of the public record. • The Clerk, while providing access to public records, understands which documents and information are confidential and acts accordingly with tact and diplomacy.
