An Insight into Legal Advice and how it differs from Legal Information Legal advice is the giving of professional or formal opinion in accordance with a law and in relation to particular factual situation. It usually includes advice regarding the substance or procedure to be followed. Providing legal advice involves analyzing legal facts and provisions and then suggesting a particular course of action based on the applicable law. It should be noted that legal advice is chargeable in the form of financial or other compensation. Legal advice provided without any kind of compensation is called as pro bono. To be able to provide legal advice, a lawyer or authorized professional in the field of law will likely ask their clients a set of questions to understand the matter at hand, consult legal books and previous case laws and then provide appropriate advice as to the best course of action in their opinion. Therefore, it is important for a layer to understand the case in question properly before offering any legal advice. Since every legal situation is unique, therefore a lawyer who specializes in a particular legal domain, such as business, real estate or personal injury, will be able to provide appropriate legal advice. Legal Advice vs Legal Information Legal advice is different from legal information in a number of ways. Here is the main difference between the two: • Legal information is more general in nature and therefore not specific to any particular case regarding a person. Legal information can be provided by anyone even if they aren’t a lawyer or legal expert. Legal information is also available in public and thus anyone can conduct their research and get legal information. • Legal advice is generally specific to a particular case and concerns a certain individual or group of individuals. Moreover, it can be provided only by an attorney or judge who is qualified to do so. The following activities can be said to be part of Legal Advice • Analysis of the legal facts of the case and requisite documents in respect of the case

  2. • Drafting of reply to concerned legal authorities with detailed analysis, interpretation and best representation • Providing requisite assistance in following up with authorities in regards to the queries and information sought by authorities • Representing the client in the court of law in front of the judge It is important to note that legal advice is an extremely personalized mechanism and this means that legal advice provided by different practitioners can actually differ. Therefore, one must carefully take into consideration different parameters before deciding to hire a legal expert.
