    3. The New SAP Rule - The Basics All SAP policy requirements are now set forth in the Standards for Student Eligibility under section 668.34 except the requirement to establish, publish and apply SAP standards in 668.16(e) 3

The New SAP Rule – The Basics In order to receive Title IV, HEA program funds, students must be eligible under Subpart C of Section 668 A student who does not achieve satisfactory academic progress is not an eligible student under section 668.34(a)(7) Therefore, if a student fails to achieve satisfactory academic progress, the institution may not disburse Title IV, HEA program funds to the student 4

The New SAP Rule – Reasonable Policy The new regulation requires institutions’ SAP policy to contain 11 elements including the 6 currently required Under the new regulation, the Secretary considers the institution’s SAP policy to be reasonable if the 11 elements set forth in 668.34(a) are met 5

The New SAP Rule – Reasonable Policy Element 1 – 668.34(a)(1) Same as current 668.16(e)(1) SAP policy standards must be as least as strict as the institutional SAP standards for non-Title IV students enrolled in the same educational program as the Title IV student for whom the SAP policy standards will apply 6

    7. The New SAP Rule – Reasonable Policy Element 2 – 668.34(a)(2) Same as current 668.16(e)(3) SAP policy must provide for consistent application to all students within a student category Category = full-time, part-time, undergraduate, graduate, etc. 7
