  2. The Main Idea Of The Article • To Establish the third branch of government, the Judiciary branch

  3. Section I • There is One supreme court in the US and the other lower courts established congress • Any Judge in the supreme and inferior courts hold the post for life as long as they have good behavior. • While in office they will get paid for their services

  4. Section II • Clause 1 • People are entitled to the judicial power, it extends to all cases. • Oversees all treaties and laws of the United States • Oversees all cases pertaining to foreign, diplomatic, between states and high value individuals such as foreign ambassadors or foreign leaders. 2. Clause 2 • Any cases regarding Ambassadors, other public Ministers and Consuls the supreme court will hear the case for the first time. • In all other cases the supreme court will hear cases upon appeal from lower courts. 3. Clause 3 • When someone is accused of a crime, they will be tried by jury in the state of which the crime was committed • In the case of Impeachment trial will not be by jury.

  5. Section III • Clause 1 • The constitution states," Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort." This means that treason against the United States is starting war against them or helping their enemies. • A person can only be convicted of treason if there are 2 witnesses or if they confess to treason. • Clause 2 • Congress has the power to decide the punishment for treason. • The worse punishment for treason is death

  6. Which one we think is most important? Section 1 is the most important: • Basis for the rest of the article • Sets up two levels of courts: Supreme and Inferior courts • Ensures the judges will be impartial by assuring they will not lose pay as a result of their verdict.

  7. Constitutional Principles • The Judicial Branch interprets the laws the legislative branch makes and the executive branch enforces. • The judicial keeps both the legislative and the executive branch in check, by having the power to call their actions unconstitutional.
