  1. When a person reaches .08 BAC, it is illegal for him or her to drive a vehicle. To reach a .08 BAC level, a 170-pound man would have to drink about four drinks in one hour on an empty stomach. A 137-pound woman would have to drink about three drinks in one hour on an empty stomach. When drivers reach .08 BAC, their critical driving skills, like judging distance and speed, steering, visual tracking, concentration, braking and staying in driving lanes are severely impaired. 2009 1st EDITION DWI for DUMMIES ¹At a .08 BAC level, a person is 11 times more likely to be involved in a fatal crash than someone who has had nothing to drink.¹(Zador, 2004) AGGRAVATED DWI – 1) Refusal to take a BAC test at time of arrest 2) Testing at a BAC of .16 or higher 3) Causing bodily injury to someone while driving under the influence of alcohol/drugs. FINES and FEES – On average the 1st time DWI offender pays just under $2000.00 (license fee, criminal lab, community service, interlock, alcohol screening, DWI school, etc.) Does not include increased insurance costs, treatment, lost wages, towing and storage, attorney fees, etc. IMPAIRMENT– Is the point where one’s intake of alcohol/drugs affects their ability to perform appropriately. INTOXICATION – A legal term that establishes a certain level of alcohol in the blood as the point of impairment severe enough that criminal sanctions are enforced. BAC defined – Blood alcohol concentration is a measure of how much alcohol is in someone’s blood. It is the most accurate and measurable gauge of alcohol impairment .08 Per Se – Law that makes it illegal for a person to operate a motor vehicle within NM at an alcohol concentration of eight one hundredths or more in his/her blood or breath. .04 + BAC – It is unlawful for a person who has an alcohol concentration of four one hundredths or more in his blood or breath to drive a commercial motor vehicle (CDL) within N.M. .02 + BAC – It is unlawful for any person under the age of 21 to have an alcohol concentration of two one hundredths or more in his/her blood or breath. Always Designate a driver! Even if a drinker believes he or she can drive after only one drink, he or she may be impaired. The law says it is illegal for a person impaired by alcohol and/or drugs to drive a vehicle. Buzzed Driving isDrunk Driving. The safest rule to follow is not to drive when you have been drinking and never ride with anyone who has been drinking. Rio Arriba County DWI Planning Council
