The Guide Law How an idea became a reality? • In 2013, the Center of Legal & Judicial Studies within the Ministry of Justice has organized a seminar “ Prevention of Defamation of Religions“ . • This seminar had discussed the different challenges related to the Defamation of Religions with especial focus on the legal matters. • The seminar reached several conclusions including the importance and need for a regional updated module law. • A further step , was to draft the module law and present it to the Arab Council of the Ministers of Justice within the Arab League. • After, a long , constructive dialogue between member states of the Arab League, the Council in its (29) Annual Session have adopted the amended version of the Guide Law.

  4. Aims & Goals Of The Arab Guide Law • Provide “Legislative Technical Assistance” to Member States of Arab League . • Present a balanced solutions for the :- • Respect of Religions & • Freedom of Expression

  5. Main Features Of The Arab Guide Law • The Guide Law have the following characteristics:- • Legislative Treatment. • Comprehensive Legal Framework. • Flexible Provisions.

  6. Main Legislative Components of the Arab Guide Law • The Guide is divided into ( 3 ) Chapters. • Consisted of ( 25 ) Articles.

First Legislative Component :- Enshrines Freedom, respect, Citizenship & Tolerance • Articles (2) & (3) of the Guide Law ensures the following Core Values of Human Rights:- • Respect of religions is one of the main pillars of human rights, freedom & citizenship. • Tolerance & dialogue is indispensable for respect of religions. • Rule of law defines what is considered as defamation of law.

Second Legislative Component :- Preventative measures against defamation of Religions • Articles (6) – (20) defines the acts & offences that consist defamation of religions, including :- • Vandalism or destroy of worship places . • Insulting religions . • Desecrating of holy books. • Disrespecting of messengers, their families & companions.

  9. Third Legislative Component :- Provide other Alternatives legal procedural • Articles (21) – (25) of the Guide Law provide other legal procedures for example:- • Authority of the Judiciary to ban dissemination or publish of religions defamation offences. • Stipulate civil compensations against defamation offences.

Conclusions • The Arab Guide Law is the first of its kind on the regional level. • The Arab Guide Law presents a comprehensive flexible legislative framework for the defamation of religions, in accordance to core values and rules of Human Rights. • The Guide Law ensures a balanced protection of the respect of religions & freedom of speech.
