  1. Title VI • applies to money paid, property transferred, or other Federal financial assistance extended to any such program or activity.

Limited English Proficiency (LEP) • Executive Order 13166 dated 8-11-2000; Federal Register dated 12-19-2003 • Improve access to limited LEP (persons who cannot communicate in English) eligible participants of Federally funded programs • Enforcement under Title VI of the Civil Rights Act of 1963 on the basis of national origin

  3. LEP – How does a recipient determine the extent of its obligation? • Number or portion of LEP persons eligible or likely to be served. • Frequency with which LEP persons contact the program • Nature & importance of the program - documents • Resources available to recipient & cost

  4. Develop an LEP Plan • Identify LEP individuals who need language assistance – identify languages • Identify types of assistance to be provided. • Train staff of their obligations • Notify LEP persons of the services provided. • Monitor and update the LEP plan as needs change.

  5. LEP - Safe Harbor Starting point for recipients to consider! • Where LEP population exceeds 5% or 1,000 persons • Translation of essential documents for each LEP group can be oral or written • Where LEP population exceeds 5% but less than 50 persons • Provides a notice in the primary language of the LEP group which outlines right to receive competent oral interpretation of written materials and/or interpreters.

  6. LEP - Safe Harbor Starting point for recipients to consider! • Safe harbor for translation of written documents only. They do not affect the requirements to provide meaningful access to LEP persons through competent oral interpreters where oral language services are needed and are reasonable.
