  2. Goal • Increase environmental and public health benefits while clarifying the regulatory process for stakeholders.

  3. Overall Objectives • Bring MassDEP asbestos regulations up to date with EPA’s Asbestos NESHAPs. • Better aligns MassDEP and MassDLS regulations. • Clarify MassDEP asbestos abatement work practices. • Creates Alternative Work Practice permits and fees. • Strengthens enforcement.

  4. Specific Initiatives • Operation and maintenance standards for small scale asbestos abatement; • Permits for alternative work practices in situations where traditional asbestos abatement is not feasible; and • Relief from notification requirements for owners of single family, owner occupied residences where the owner conducts the non-friable ACM removal.

  5. Some of the new requirements • Clarifies the need to conduct a pre-demolition/renovation asbestos inspection(survey)in line with EPA’s NESHAP requirement. • Use waste shipment records (consistency with EPA’s NESHAP and will help to ensure compliance with waste management requirements). • Material-specific O&M procedures for certain non-friable ACMs. • Alternative Work Practice permits for non-traditional asbestos abatement that will ensure a consistent application, review and decision making process.
