  4. Sessions In session from October through June/July Hear cases during the first two weeks of the month Decide which cases to hear, research cases, write opinions during the last two weeks

  5. The Cases Original Jurisdiction Issues involving constitutional granted jurisdiction Involving representatives of foreign governments Disputes between states Appellate Jurisdiction Must have been appealed through lower courts (District > Court of Appeal > Supreme Court or from a State Supreme Court) Only hear cases that involve significant constitutional issues Judges choose which Appellate cases they want to hear (4 must agree)

  6. The Supreme Court’s Decision After hearing cases, justices meet in private to discuss opinions Chief Justice begins discussion and offers his opinion Then proceeds from oldest member to newest member Must have a majority (5 votes) to decide a case

  7. Types of Opinions Majority Drafted by the justices on the majority side, states their reasons for their decision Concurring Agrees with the majority side, but for different reasons Dissenting Written by the minority in the court, states why they oppose the decision

  8. The Changing Court The make-up of the court has changed over time as different justices have been appointed Presidents try to appoint justices with similar political views Sonia Sotomayor & Elena Kagan are going to lean towards judicial activism as opposed to judicial restraint
