  1. Welcome at EPZ Nuclear Energy in the Netherlands

Present situation Nuclear Power • 1 Nuclear Power Station of 495 Mw • Situated in Borssele (South West part of the country) • Type of reactor: Pressurized water Reactor, Siemens Design • In operation since 1973 • Originally foreseen technical lifetime 40 years (2013) • Intended shut-down in 2003, initiated by the government • Agreed Lifetime extension in 2006 (covenant) • Shut-down on 31 December 2033 • Research reactor in Petten (medical isotopes) • Research reactor in Delft (technical university) • Closed Power Station (54 Mws) in Dodewaard

Present Legislation • Nuclear Act since 1963 • Article 15 sub b “a licence is required for constructing and operating a nuclear power plant (…..)” • Decree on Nuclear Installation, fissile material and ores • Chapter II Licence application and instructions • Article 6 further specifications for licence application conc. Constructing and operating a NPP • No formal moratorium on New build

Nuclear Bill • The Nuclear Bill (no 30 429) has passed the House of representatives on 13 October 2009 • Relevant part for New build is the financial chapter (new article 15 f), which says: • The licence holder of a NPP is obliged to provide financial security in order to be able to cover the costs related to shut-down and decommissioning of the NPP by means of a: • Contract of surety ship or bank guarantee; or • Participating in an external fund (bankruptcy remote); or • Any other way of security to be approved by the competent Minister.

  5. Green light for New Build? • No formal legal restrictions for licence application However, • New Nuclear is considered as a matter of national importance • Coalition agreement (Christian Democrats, Social Democrats and Union of Christians (left wing)) says: • No nuclear will be built during this administration

Present situation • Ministry of Economic Affairs started a consultation round with stakeholders on the possiblity of New Nuclear • Results will be published first quarter of 2010 • 3 possible outcomes: • No new nuclear or no new nuclear unless inherent safe (Gen IV) • Replacement of the Borssele Plant in 2033 • New nuclear after 2020 • Which requires preconditions (Design assessment, siting etc)

Site selection • Structure plan for Supply of Electricity (SEV III) • SEV III has been adopted end of June 2009 • New Nuclear is not excluded in SEV III • Part of SEV III was a Strategic Environmental Assessment (SEA) for new NPP’s • 3 possible locations for New Nuclear: • Groningen/ Eemshaven • Rotterdam area/ Maasvlakte • Borssele

DELTA initiative • DELTA (50% shareholder of EPZ) sent a preliminary memorandum Environmental Impact Assessment (EIA) to the ministry of Environmental Affairs (=competent authority) in June 2009 • Next step will be: Instructions for the EIA to be received from EIA committee • Drafting EIA and Safety Analyses Report • Next government (at the latest 2011) will take decission on New (more) Nuclear. • licence application will take place not earlier than 2011

  9. Conclusion • No legal restrictions for licence application • But no licence without political consent • Preparations for licence applications by DELTA c.s. will put pressure on competent authorities to develop policy on environmental and technical preconditions
