  2. 总体流程 确认开发商售楼是否有合法文件 购房查询 签订认购书并交定金 签订预售合同或买卖合同 办理购房公证 交易中心办理预售登记备案并结汇(二手房买卖不需预售登记,但须报购房地安全局审批同意) 从境外或境内外汇帐户支付购房款 同物业公司签订物业管理合同 办理房屋交付手续 完成产权设立或过户手续

General Procedures Check the licenses for house-selling of developers House-purchase inquiry Sign the purchase letter and pay the deposit Sign the contracts Notarize the house-purchase Trading center for pre-sale registration and settlement (pre-sale second-hand housing transactions are not required to register, but must be approved by Security Bureau of the purchase place) Pay the purchase with foreign exchange account inside or outside of China Sign the property management contract with property management company Housing delivery Set up property rights or finish escrow procedures

  5. 购买商品房的条件 • 购房人的资格:境外机构的在华分支机构和代表机构(房地产企业除外);在中国境内工作、学习时间超过一年的境外个人;港澳台居民和华侨。 • 购房类型:商品房(不可以购买公房和经济适用房) • 购房用途:自用、自住 • 采取实名制(同时注明中文和外文姓名),并持有效证明(中国批准来中国工作、学习的证明) • 特别提示:目前,京津地区已经暂停执行限制外籍人士在该地区购房所需的居住年限和所购房屋数量的政策。

  6. Requirement for Real Estate Transactions • Buyers’ qualifications: Chinese branches and agencies of external institutions (except for real estate companies), foreigners working or studying in China over one year, Hong Kong, Macao and Taiwan residents and overseas Chinese. • Type of housing: commercial housing (public housing and economical housing are not allowed to purchase) • Purchase purposes: personal use • Real-name requirement:(both Chinese name and foreign name), valid certificate are also required (certificate of China’s ratification of foreigners working and studying in China) • Special note: at present, it is suspended that the policy of restrictions on foreigners’ transaction requirements which are residential time and the number of housing purchasing in Beijing-Tianjin Area.

  7. 所需证件、文书 • 身份证明 • 译名公证或《工作证》 • 有效居住证证件(需同时注有中文及外文姓名) • 向国外及港澳台人员租、售房屋审批表 • 《委托书》 • 以上证件、文书非中文书写的文件,需到具有翻译资格的翻译公司翻译,应同时附经公证和认证的中文译本,程序:经该外籍人士所在国公证机关公证,且经中国驻该国使、领馆认证。

  8. Certificates and Documents Needed • Identification paper • Notarization of Chinese name or working license • Valid residence permit (both Chinese name and foreign name) • Approval form for housing rent and purchase with foreigners and Hong Kong, Macao and Taiwan residents • Power of Attorney • Certificates, documents and other non-Chinese papers should be translated by qualified translation companies and be enclosed the notarized and authenticated Chinese edition. Procedures: firstly, notarization from the host country of the foreigner, secondly, the authentication of Chinese Embassy in that country.

  9. 购房资金 • 自有资金 • 银行贷款,可向外国银行或中国银行贷款 • ●评估由银行来执行(选择权由购买者来决定) • ●币种:外币或人民币(可选择,建议选择人民币贷款,这样不必考虑外币与人民币之间的转换,避免汇率的变动) • ●贷款利率:外籍人士享受与中国人相同的待遇,按照中国人民银行规定的个人住房贷款利率执行

Purchase Fund • Their own funds • Loans of banks, both Chinese banks and foreign banks are allowed • ●Appraisal is required by the bank (option by the buyer) • ●Currency: foreign currency and Renminbi are all acceptable (it is recommended to choose Renminbi to avoid exchange rate risk) • ●Loan rate: foreigners are equaled with Chinese on interest rate, which is in accordance with regulations of People's Bank of China on loan rate of individual housing.

  13. 税 费 • 税费种类(三税四费 ) • “三税”:外商投资企业、境外机构设立代表处或分支机构和外国个人在境内购买房产,主要缴纳城市房产税、契税、印花税。购房所交纳的税率,与中国国民交纳的相同。 • A.城市房产税: • B.契税: • C.印花税: • “四费”:产权登记费、住房交易手续费、房产测绘费、合同鉴证费 • 上述税款于办理产权登记前缴纳。

  14. Taxes and Fees • Types of taxes and fees (three kinds of taxes and four types of dues) • “Three Taxes”: Urban House Tax, Deed Tax and Stamp Tax. Tax rate for foreigners and Chinese are the same. • A. Urban House Tax • B.Deed Tax • C. Stamp Tax • “Four Fees”: Property Registration Fee, Housing-purchase Service Fee, Housing Mapping Fee and Contract Appraisal Fee. • Taxes and Fees should be paid before the property registration.

  15. 权属登记及产权证件办理 • 以天津市为例,其他省市类似。 • 外国人申请登记的,应当向登记机构提交身份证或者护照。外国企业驻国内机构申请登记的,应当向登记机构提交代表机构登记证。 • 在外国和港澳台地区登记注册的法人或者其他组织申请登记的,应当向登记机构提交有关的登记证明。 • 申请登记文件是外文的,应当同时提交中文译本。 • 境外当事人申请房地产登记的,还应当按相关规定办理公证或者认证手续并且提交相关的证件、文件。

  16. Property Registration and Ownership Certificate • Take Tianjin as example since the requirements in other cities are similar. • Foreigners applying the registration should submit I.D card or passport. Chinese branches and agencies of foreign institutions applying for the registration are required to submit their registration certificate. • Companies and other institutions registered abroad and in Hong Kong, Macao and Taiwan Area applying for the registration should submit the registration certificate. • Chinese edition are required to enclosed when the applying documents are written by foreign languages. • Parties abroad applying for the registration should also deal with notarization or authentication procedures in accordance with relevant regulations and submit relevant certificates and documents.
