  2. Scope • Applies to construction products: “any product which is produced for incorporation in a permanent manner in construction works, including both buildings and civil engineering works” • The “Shaking Giant” analogy

  3. Application • The CPD dates from 1988, yet is only just now coming into effect. Why? • CPD is an irregular directive: the directive is only applicable if there is • A Harmonised Standard Or • A European Technical Approval

  4. European technical Approval • European technical approval may be granted to • products for which there is neither a harmonized standard, nor a recognized national standard, nor a mandate for a harmonized standard, and for which the Commission, after consulting the committee referred to in Article 19, considers that a standard could not, or not yet, be elaborated; and • products which differ significantly from harmonized or recognized national standards. • Process can be expediated by a European Technical Approval Guideline • Requested by the manufacturer to an approval body • Valid for five years • Free rider principle

  5. Essential Requirements • Mechanical resistance and stability • Safety in case of fire • Hygiene, health and the environment • Safety in use • Protection against noise • Energy economy and heat retention

  6. Conformity Assessment Procedures The relevant ETA or Harmonised Standard determines: • The classification (no pass/fail): see example of EN14351-1, classification of windows and doors • The conformity assessment procedure (modules)

Certificate of Conformity • Issued by the Notified Body to the Manufacturer • The EC certificate of conformity shall contain in particular • name and address of the certification body • name and address of the manufacturer or his agent established in the Community • description of the product (type, identification, use...) • provisions to which the product conforms, • particular conditions applicable to the use of the product, • the certificate's number, • conditions and period of validity of the certificate, where applicable, • name of, and position held by, the person empowered to sign the certificate.

Declaration of conformity • Issued by the Manufacturer to the User • The EC declaration of conformity shall contain in particular: • name and address of the manufacturer or his agent established in the Community • description of the product (type, identification, use ...) • provision to which the product conforms, • particular conditions applicable to the use of the product, • name and address of the approved body, • name of, and position held by, the person empowered to sign the declaration on behalf of the manufacturer or of his authorized representative. • The certificate and declaration of conformity shall be presented in the official language or languages of the Member State in which the product is to be used

  10. Marking • the name or identifying mark of the producer, • the last two digits of the year in which the marking was affixed • the number of the EC certificate of conformity • indications to identify the characteristics of the product on the basis of the technical specifications.

  11. Shared ITT and Cascade ITT • Shared ITT: Tests can be shared between companies, but each company still needs to get a certificate • Cascade ITT: Central company obtains CE, all subcontractors can use the same certificate. • Only possible when specifically mentioned by the standard. • Other specifications required by the directive (ex: contract between supplier and client, product families,…)
