  2. As of today, State compliance is required by January 30, 2012 that all CDL holders must certify they meet one of the following medical requirements:

Non-excepted Interstate: I operate or expect to operate in interstate commerce and subject to and meet the qualification requirements in section 391 and am required to obtain a medical examiners certificate. • Excepted Interstate: I operate or expect to operate in interstate commerce, but engage exclusively in transportation or operations excepted in section 391 from all or parts of the qualification requirements and therefore not required to obtain a medical examiners certificate. • Non-excepted Intrastate: I certify that I operate only in intrastate commerce and therefore are subject to State driver qualification requirements. • Excepted Intrastate: I certify that I operate in intrastate commerce but engage exclusively in transportation or operations excepted from all or part of the State driver qualification requirements.

  4. Compliance Deadline • All CDL holders must comply with the requirement to submit their self-certification on whether they are subject to the physical qualification rules by January 30, 2014

The Federal Rule requires the Bureau of Motor Vehicles to obtain medical certification status and a self-certification form at the following times: • Individuals applying to obtain a CDL • Individuals renewing their CDL • Individuals upgrading their CDL • Medical Certificate Expiration Therefore this is NOT a one time deal Note: Bureau of Motor Vehicles will NOT obtain medical certification status when obtaining a duplicate license.

What is the Bureau of Motor Vehicles Planning • Once we receive guidance from FMCSA, we will send out an introductory letter to all CDL holders. • If a CDL expires beyond two years of implementation, letters will be sent to those drivers requesting they comply with the new federal rule prior to the January 30, 2014 deadline.

  7. Currently writing policy and procedure regarding new rule. • Making system changes to accommodate the medical certificate information. • Working on a training program for staff. • Creating letters (renewal notices, downgrade notices, notification letters, etc.)

  8. Recertification Process • Since the medical certificates generally expire two years following issuance, the recertification process cannot be tied to the CDL renewal process because CDL’s expire on the holders’ fifth birthday following the date of issuance. However, certification will be required at renewal for all CDL holders.

  9. Medical Certificates and Self-Certification Transmission • Bureau of Motor Vehicles is planning on accepting medical examiner’s certificates and self-certification forms via fax or scanned copies via e-mail. • Medical examiners certificates and self-certification forms will also be accepted via USPS. • Self-certification forms and medical certificates will be accepted at all branch office locations. • All variances will be done through the Main Office.

  10. Downgrade ProcessLast resort - We do not want to do this • The driver will have 60 days from medical certificate expiration to provide us a “valid” medical certificate. If the driver is unable to provide us a medical certificate, he/she will have the option of self- certifying to an excepted category. If they choose not to self-certify to an excepted category, we will take action to remove the CDL privilege from the driver license.
