  2. Introduction Bail means releasing an accused person awaiting trial on temporary basis. According to Canadian law a person charged with an offense can demand a bail. However, the police can release the persons without a bail if the person is involved in ordinary offense.

  3. Bail Hearing Process A bail hearing takes place in court, where the crown presents evidence to demonstrate why you shouldn't be granted release. On the other hand, your defence lawyer works to have you released on bond.

  4. Bail Hearing Process It is observed during the bail hearing procedure, that whether it is safe or not to release the accused person into the community. The court also decides the terms and restrictions which should be applied on the person.

  5. The Decision The decision of bail is made by the Justice after analysing facts,accused, testimony by witnesses and the details of allegations, and witnesses. The crown prosecutor and your lawyer are given the opportunity to speak but they can not involve in the final decision.
