Magnuson Stevens Fishery Conservation and Management Act EFH Information Review MSFCMA § 305(b)(1) …The Secretary shall set forth a schedule for the amendment of fishery management plans to include the identification of essential fish habitat and for the review and updating of such identifications based on new scientific evidence or other relevant information.

Magnuson Stevens Fishery Conservation and Management Act EFH Information Review 50 CFR 600.815(a)(10) Councils and NMFS should periodically review the EFH provisions of Fishery Management Plans and revise or amend EFH provisions as warranted based on available information… …A complete review of all EFH information should be conducted as recommended by the Secretary, but at least once every five years.

Guidelines for 5-Year EFH Information Reviews • Purpose of 5-year EFH Review: • Ensure compliance with EFH Regulation • Best available scientific information is used to justify management actions, as required by National Standard 2 • NMFS is following NEPA guidance regarding periodic review and update of NEPA documents.

Roles of Councils and NOAA Fisheries: • Work together in reviewing EFH sections of FMP’s and amendments • Councils can report findings in annual Stock Assessment and Fishery Evaluation (SAFE) reports • Document workshop summaries, contracted analysis, technical memoranda • Independent expert review by Council SSC, Science Center staff, or outside scientific experts

Scope of 5-year EFH Information Review: • Identification and Description of EFH and EFH-HAPCs • Minimization of Adverse Effects of Fishing • Identification of other measures to conserve EFH • Through: • Evaluating published scientific literature • Evaluating unpublished scientific reports • Soliciting information from interested parties • Searching for previously unavailable or inaccessible data

Guidelines for 5-Year EFH Information Reviews • Documentation • Report summarizing changes in EFH information • Identify considerations that influenced review • Species added/eliminated from FMU • Changes in overfishing/overfished status • Changes in restoration techniques • Errors in existing identifications/descriptions • New scientific information • New analytical techniques/models • Changes in gear or new gear information
