  2. TERMS • HCMI will be the sole entity with authority to contract to market and recruit applicants for residency training in DOH Teaching & Training Hospitals. • DOH will be responsible in regard to Post Graduate Residency Training Program.

  3. 1987 PHILIPPINE CONSTITUTION • “ the practice of all professions in the Philippines shall be limited to Filipino citizens, save in cases prescribed by law” Section 14, Article XII

  4. THE MEDICAL ACT OF 1959 (RA 2382) • Exemptions – The preceding shall not be construed to affect (a) any medical student duly enrolled in an approved medical college or school, or graduate under training, serving without any professional fee, in a government or private hospital, provided that he renders such service under the direct supervision and control of a registered physician; xxx” Section 11, par. (a)

  5. Professional Regulation Commission Resolution No. 98 - 547 • “Foreign Professional” shall refer to a person other than a Filipino citizen qualified by appropriate education and training and registered as professional and issued a license to practice his profession in his own country and who is or may be legally engaged to render or do the acts or services which constitute the practice of the regulated profession in the Philippines. Section 1.e

  6. ADMINISTRATIVE ORDER No. 29 s. 1994 • Medical Human Resource Development and Placement Program of the Department of Health • “ applicants to residency training program must be Filipino citizens” Item IV.1.2.1
