Privacy & Confidentiality of Protected Health Information • Health Insurance Portability and Accountability Act of 1996 (HIPAA) • Ensures that all medical records, medical billing and patient accounts meet certain consistent standards with regard to documentation, handling and privacy. • Protected Health Information (PHI) • Includes: • Paper and electronic medical records. • Billing and administrative records that identify patients by name, medical record number, address, social security number, etc.

Privacy & Confidentiality of Protected Health Information “Need To Know” Rule: Under HIPAA and MHRI’s policy, you may not access patient information (PHI) unless doing so is necessary to your job duties. • DO NOT view the PHI of a co-worker, relative or friend when there is no work-related reason to do so. • DO NOT look at any patient’s paper or electronic medical record just to “look”. • “Las Vegas” Rule: • Don’t “discuss” patient information out side of the hospital. What you learn • here should stay here.

Privacy & Confidentiality of Protected Health Information • Monitoring Use of MHRI’s Electronic Information Systems: • Your use of the system is subject to audit. • It can be determined who accessed each patient’s record and the dates and times this was done. • FOR YOUR PROTECTION, YOU MUST LOG OFF THE COMPUTER WORKSTATION EACH TIME YOU LEAVE IT UNATTENDED. Violations of MHRI’s policies concerning confidentiality and security may result in disciplinary action up to and including termination of employment.

  5. Privacy & Confidentiality of Protected Health Information • Questions and Concerns • You are encouraged to report to the hospital’s privacy officer (ext. 2148) any questions or concerns you have about privacy or confidentiality.

  6. MHRI’s Corporate Compliance Program • Corporate Compliance Program: • designed to maintain the hospital’s culture of ethical integrity. • Promotes continuing adherence to legal requirements related to billing, reimbursement and other business functions. • Hospital Policy Corporate Compliance 2: • Corporate Compliance code of Conduct outlines principles and standards for proper business practices and describes some of the primary laws, such as the Federal Civil False Claims Act, that are designed to deter improper business practices.

  7. MHRI’s Corporate Compliance Program • Employees are encouraged to report any instances of possible non-compliance with business practices standards. • Report concerns to your immediate supervisor, an operations manager or vice president. • Report anonymously to the corporate compliance officer at ext. 2148. • No disciplinary retaliation will result from reporting a concern
