  2. Board of County Commissioners Project : Isleworth Four Corners PD/LUP Substantial Change Applicant:John T. Townsend District #: 1 Request: To consider a substantial change to the approved Isleworth Four Corners Planned Development/Land Use Plan (PD/LUP) to grant a waiver from Section 38- 1356(n) and Section 38-1372(j)(1) to allow a maximum building height of 54 feet for a previously-constructed dome which will be mounted upon an existing building in the Southeast Quadrant.

  6. Board of County Commissioners Action Requested • Find the request consistent with the Comprehensive Policy Plan and approve the Substantial Change to the approved Isleworth Four Corners PD/LUP dated “Received July 7, 2009,” subject to the four (4) conditions in the staff report.

  7. Board of County Commissioners DRC Recommendations 1. Development shall conform to the Isleworth Four Corners PD Land Use Plan dated “Received July 7, 2009,” and shall comply with all applicable federal, state and county laws, ordinances and regulations, except to the extent that any applicable county laws, ordinances or regulations are expressly waived or modified by any of these conditions. Accordingly, the PD may be developed in accordance with the uses, densities and intensities described in such Land Use Plan, subject to those uses, densities and intensities conforming with the restrictions and requirements found in the conditions of approval and complying with all applicable federal, state and county laws, ordinance and regulations, except to the extent that any applicable county laws, ordinances or regulations are expressly waived or modified by any of these conditions. If the development is unable to achieve or obtain desired uses, densities or intensities, the County is not under any obligation to grant any waivers or modifications to enable the developer to achieve or obtain those desired uses, densities or intensities.In the event of a conflict or inconsistency between a condition of approval of this zoning and the land use plan dated "Received July 7, 2009," the condition of approval shall control to the extent of such conflict or inconsistency.

This project shall comply with, adhere to, and not deviate from or otherwise conflict with any verbal or written promise or representation made by the applicant (or authorized agent) to the Board of County Commissioners at the public hearing where this development was approved, where such promise or representation, whether oral or written, was relied upon by the Board in approving the development, could have reasonably been expected to have been relied upon by the Board in approving the development, or could have reasonably induced or otherwise influenced the Board to approve the development. For purposes of this condition, a “promise” or “representation” shall be deemed to have been made to the Board by the applicant (or authorized agent) if it was expressly made to the Board at a public hearing where the development was considered or approved. 3. A waiver from Section 38-1356(n) and Section 38-1372(j)(1) to allow a maximum building height of 54 feet for a previously-constructed dome which will be mounted upon an existing building in the Southeast Quadrant. 4. All previous Conditions of Approval shall apply.

Board of County Commissioners Proposed Use:Development in accordance with the approved PD Land Use Plan (LUP) Timeshare – up to 4,159 units Ground Floor Commercial – up to 60,000 square feet of C-1 (Retail Commercial District) uses Recreation – conventional recreation facilities, including sport courts, pools, and fitness centers. In addition, nature trails, a beach, boating facilities, and a fitness tower are proposed.

Jain Request:Approve text amendment to Section 38-1372(c)(1)b to allow for the redevelopment of Parcel ID# 16-23-28-0000-00-011 to have an FAR of 0.25 in lieu of 0.14.

Four Corners CVCText Amendment If Parcel ID No. 16-23-28-0000-00-011 is redeveloped, it shall be redeveloped only for office use at the greater of 0.14 with a 0.25 floor area ratio (FAR) or the intensity existing on October 29, 1996, based on trip generation, and to appear and function only as a single, unified and integrated development with the other non-residential development in the southwest quadrant. Such redevelopment shall be submitted as a planned development in accordance with these guidelines and standards. For purposes of this article, FAR shall be calculated based upon gross acreage of the affected parcel .

Board of County Commissioners LPA Recommendation • On July 16, 2009, the LPA made a finding of consistency with the Comprehensive Policy Plan and recommended to approve the text amendment to Section 38-1372(c)(1)b to allow Parcel ID Number 16-23-28-0000-00-011 to redevelop only for office use with a 0.25 Floor Area Ratio, and to appear and function only as a single, unified and integrated development with the other non-residential development in the Southwest Quadrant.

  17. Four Corners CVCText Amendment Next Steps Return to the Development Review Committee on August 26, 2009, for decision only on the Emergi-Care PD / Land Use Plan. Emergi-Care PD rezoning to be heard by the Planning & Zoning Board on September 17, 2009. Public hearing for Emergi-Care PD rezoning to be heard by the Board of County Commissioners late October or early November.
