Validation of notifications
  • 1200 rules are notified:
    • Clarified and renewed notifications of existing rules received in 2008 (less than 1000 rules, i.e. 5 times less than in 2005)
    • Rules of Bulgaria and Romania
    • New rules of other countries
  • So far 618 rules are uploaded to the PDB.
    • Some of these rules have been uploaded by the MS/NSA’s as part of the actual notification.

(the new Interoperability Directive)

  • Directive 2008/110/EC amending the Railway Safety Directive

Type 3 rules are now included as national technical rules to be notified under Article 17 (3) of the Interoperability Directive.

The Commission is introducing a new electronic system for notifying NSR and NTR:

RISD – Railway Interoperability and Safety Database

Planned use as from September 2009

    • Unique entry point for all notifications (safety and technical rules)
    • Automatisation of notification process
    • Harmonization of content

  • Assure persistence of information
  • Facilitate its retrieval

  • Organise workshop on the use of the database
  • Update Guideline for NSR notification (procedure and use of rule declaration form)

  • A consortium, KEMA - CETREN, has interviewed ministries, NSA, RU and IM in 17 MS and CT during March-April 2009
  • The consortium will deliver report end July 2009 with information from the interviews
  • As in phase I, the report will be sent to the concerned NSR contact persons for validation

The Agency will:

  • examine the notified rules using the findings in the report from the consortium
  • prepare a combined report for phase 1 and 2 concerning the publication and availability of the rules
  • deliver recommendations to the Commission for publication of the rules in order to make the relevant information more easily accessible - end 2009

The Agency assists the Commission:

  • First technical advice to the Commission was issued on 3 April 2009
  • The Agency evaluates national laws implementing the Directive 2004/49/EC (mandate in July 2008)

The Agency shall issue technical opinion by request of:

  • The Commission – on new national safety rules
  • DERC or regulatory bodies – on safety issues
