  3. IRA Rollover Limit Bobrow vs. the Commissioner of the Internal Revenue Service

  4. IRA Rollover Limit In the past 26 US Code Section 408 stipulated that any amount distributed from an IRA will not be included in the gross income of the distributeeif it is rolled-over no later than 60 days after the distributee receives the distribution – on an IRA-by-IRA basis.

  5. IRA Rollover Limit A member can not make an IRA-to-IRA rollover if he or she makes such a rollover involving any of the individual’s IRAs in the preceding 1-year period.

  6. IRA Rollover Limit An IRA owner can transfer funds from one IRA trustee directly to another, because such a transfer is not a rollover and, therefore, is not subject to the one-rollover-per-year limitation of 26 US Code Section 408.

  7. IRA Rollover Limit A member can only withdraw the funds from any IRA account with the credit union, with the intent of transferring the funds to another institution or IRA within 60 days, once in a 365 day period without incurring taxes and penalties.

  8. IRA Rollover Limit The IRS stated it understands the adoption of the Tax Court’s interpretation will require IRA trustees to make changes in processing IRA rollovers and in IRA disclosure documents, which takes time to implement. The new regulation will be effective after January 1, 2015.
