  2. Overview • Total Rewrite of the GSAM and GSAR • GSAM is internal policy – Grey text box • GSAR is regulatory provisions/clauses • Shows up as one document • Going on for 3 to 4 years • GSAM/GSAR Part 538 for Federal Supply Schedule (FSS) program ONLY

  3. GSAM Part 538 Rewrite • GSAM – General Service Acquisition Manual • Procedures/Guidance not Policies • Internal to GSA • Creating electronic “Hand Book” for procedures • Example: 1649 process; how to write a pre-negotiation memorandum; etc.

  4. GSAR Part 538 Rewrite • Anticipated Published final rule for GSAR Part 538 Federal Supply Schedules (FSS), December/January time frame • Incorporates other GSAR Parts that relate ONLY to FSS in to GSAR Part 538 • Example: GSAR Part 552.243-72 Modifications becomes 552.238-62 Modifications • “FSS” provisions/clauses become GSAR provisions/clauses through the Regulatory Process • No more “FSS” provisions/clauses will be allowed • All new provisions/clauses must be vetted through the Regulatory Process

CSP-1 Now SPF-1 and -2 • Commercial Sales Practices – 1 (aka CSP-1) • Currently part of GSAM • When final, will be part of GSAR • Two new disclosure provisions and titles • Sales Practices Format – Supplies and/or Services with an Established Catalog Price List – GSAR 552.238-60 (SPF-1) • Sales Practices Format – Supplies and/or Services with Market Pricing without an Established Catalog Price List, GSAR 552.238-61 (SPF-2)

  7. SPF-1 • GSAR 552.238-60, Sales Practices Format – Supplies and/or Services with an Established Catalog Price List (SPF-1) • Similar to CSP-1, just reformatted • “Cross Walk” for services with an established catalog price list • Expanded “Dealer/Reseller” spreadsheet requirement

SPF-2 • GSAR 552.238-61, Sales Practices Format – Supplies and/or Services with Market Pricing Without an Established Catalog Price List • Disclosure of “other” contract pricing • “Net” billed rates – definition included • “Cross Walk” of labor categories • Labor hour versus fixed price supplies/services

Submission Instructions • GSAR 552.238-10, Submission Instructions (Federal Supply Schedules) • Consistent submission instructions across Schedule solicitations • Ability to add additional instructions • Ties together with Evaluation Factors • Alternate I – mandatory use of electronic offers under eoffer.gsa.gov

  10. Evaluation Factors • GSAR 552.238-11, Evaluation Factors for Award • Consistent through all Schedule solicitations • Ability to add additional factors • Consistent with new Submission Instructions (GSAR 552.238-10) • Pass/Fail basis of evaluation based on Submission Instructions provision

  11. Temporary Contract Extensions • GSAR 552.238-50, Temporary Extension of the Contract Period • Temporary extension can not exceed 24 months, total • Inclusive of 5 year option period • Pricing can be adjusted during temporary extension

  12. CTA versus CPA • Contract Team Arrangement (CTA) now called Contract Partner Arrangement (CPA), GSAR 552.238-52 • FAR Part 9.6 not applicable to CPA • Everything else still the same

  13. Modifications • GSAR 552.238-62, Modifications • Moved from GSAR Part 543 • Alternate I – mandatory use of eMod – pilot process • Mandatory updating of GSA Advantage!® within 15 calendar days of modification effective date

Economic Price Adjustment • GSAR 552.238-63, Economic Price Adjustment – Supplies and/or Services with an Established Catalog Price (formerly 552.216-70) • GSAR552.238-64, Economic Price Adjustment – Supplies and/or Services with Market Pricing Without an Established Catalog Price (formerly I-FSS-969) • Clarifies that the “Cap” is not a cap, but a point at which COs should do additional market research • Removed 1 year waiting period

General Changes • Mandatory use of “eTools” such as eOffer and eMod • Mandatory uploading to GSA Advantage!® within 30 calendar days of award (GSAR 552.238-13) and within 15 calendar days of modification (GSAR 552.238-62) effective date • GSAR 552.238-82, Contractor Tasks/Special Requirements (formerly C-FSS-370) • G&A on travel • Open Market Items on Orders – FAR Part 8.4 says it can be done; GSAR says “how” it shall be done
