  1. ALL YOU NEED TO KNOW ABOUT DIVORCE IN UAE FOR EXPATS

  2. The United Arab Emirates passed Federal Law No. 30 of 220, which modified Federal Law No. (5) of 1985 (‘The Civil Transactions Laws') and Personal Law No. 28 of 2005. Several main articles of the civil transactions law have been updated to make significant changes to personal laws, especially in the UAE's family law. These reforms are bringing in a steady progression.

  3. Prior to these amendments, the relevant law was determined by the couple's nationality; however, under the new amendment, the validity would be determined by the law of the state where the marriage took place. 

  4. It is critical for Indian expats in the UAE to understand that they can seek relief from the UAE courts for any issues relating to their marriage, including divorce proceedings. The procedures for joint divorce, i.e. a divorce with both parties' consent, can be obtained from the UAE courts through direct procedures for a variety of reasons.

  5. If the couple has children, then there are additional questions to consider, including: • Who has the children's custody? • How should the other parent's visitation rights be handled?  • Who pays child care, and who is responsible for it? If the parties are unable to settle their disputes, the family advice committee will issue a "no objection certificate," which can be used to seek relief from the courts.

  6. The financial and personal effects arising from a contract or marriage will now be regulated by the law of the state where the marriage was contracted, thanks to new changes passed by UAE. With the option of ‘place of marriage' dictating both the validity and possible financial and personal consequences, this reform has far-reaching implications and potential legal implications.

  7. By selecting a location for their wedding that is not their home country or place of residence, the couple would be deemed to have followed the laws of that location to regulate all aspects of their marriage, according to the new legislation and family lawyers in Dubai. Nonetheless, the new amendments allow for the broad implementation of various foreign laws in UAE courts, with the judiciary bearing a heavy burden of adjudication and interpretation.
