MaintenanceUnderSection125OfCrPC • Maintenanceisanamountgiventoapersonwhodoesnothavesufficientmeans tosurviveorisunablemaintain,bythepersonwhoisresponsibleand neglects ofrefuses to maintainhimorher. • Forthereadyreference,theprovisioncontainedundersection125oftheActis beingreproducedhereinbelow: • 125.Orderfor maintenanceofwives,childrenandparents. • Ifanypersonhavingsufficientmeansneglectsofrefusestomaintain. • Hiswife,unabletomaintainherself. • Hislegitimateorillegitimateminorchild,whethermarriedornot, unabletomaintainitself. • Hislegitimateorillegitimatemajorchild(notbeingamarried • daughter),wheresuchchildisbyreasonofanyphysicallyormental abnormalityorinjuryunableto maintainitself. • Hisfatherormother,unabletomaintainhimselforherself. • Providedfurtherthatthemagistratemay,duringthependencyofthe proceedingregardingmonthlyallowanceforthemaintenanceunderthissub- section,ordersuchpersontomakeamonthlyallowancefortheinterim maintenanceofhiswife,childandparents. • Wife • Awifecanclaimmaintenancefromherhusbandifshedoesnothave sufficientmeanstosurviveorwhoisunabletomaintainitself.(for example,ifwifeisnoteducatedandhusbandleft himthenwifeis not unabletomaintainitself) • Thewifeincludesadivorcedwife,aswellaswivesofvoidablemarriage canalsoclaimmaintenance. • Wifeofavoidmarriagecannotclaimmaintenance,if wife2ndmarriage isnotentitledtoclaimmaintenanceevenifshenotunawareofthefact

  2. 1stmarriageheldinSavitabenSomabaiBhatiyavStatesofGujarat 2005 • Inthefollowingfourconditionthewife’smaintenancecanNOTbeallowed. • Ifsheislivinginadultery. • Ifwithoutsufficientreasonsherefusedto livewithherhusband. • Iftheyarelivingseparatelybymutualconsent. • Sheishighlyqualified(TheDelhiHighCourthassaidthatawifecannotbe entitledtomaintenancebythehusbandwhensheishighlyqualified and hasbeenearingevenafterhermarriage. • Child • Whetherlegitimateorillegitimate,minorchildrenwhoareunableto maintainthemselvesare entitledtomaintenancefromfather. • Alegitimateorillegitimatechildwhohasattainedmajoritybutisunable tomaintainhim/herselfbecauseofmentalorphysicalabnormalityor injuryshallbemaintainedbytheirfather. • Fatherisliabletopaymaintenancetohisminorchildbutrecently • UttarakhandHighCourtsaidthatmothercanalsobemadeliabletopay maintenance toher minorchild. • Parents • Itistheresponsibilityofchildrentomaintaintheirparents intheirold age.Section125containthewordhisfatherandhismother.But SupremeCourtincaseofVijayManoharArbatVsKashiRaoRajaRam Sawai,1987casehasgivenita broadinterpretationandheldthatword hishastoreadliberallysoastoincludeheralsowhichmeansparents canalsoclaimmaintenancefrombothsonanddaughter.
