    2. IS THERE A DIFFERENCE BETWEEN SAFETY & COMPLIANCE? ABSOLUTLY!

    4. The condition or state of being safe; freedom from danger or hazard; exemption from hurt, injury, or loss. Acting according to certain accepted standards; to conform, submit, or adapt as required or requested; conformity in fulfilling official requirements. DEFINITIONS: SAFETY COMPLIANCE

    5. QUESTION ???? JUST BECAUSE YOU ARE IN COMPLIANCE, DOES THIS MEAN YOU ARE BEING SAFE? IF YOU ARE BEING SAFE, WILL YOU BE IN COMPLIANCE?

    6. ANSWERS !!!! A COMPLIANT PERSON FOLLOWS THE LAW WITHOUT FAIL. A SAFE PERSON UNDERSTANDS THE INTENT OF THE LAW AND SURPASSES IT WHEN THE LAW IS FAILED.

    8. CAN YOU THINK OF ANY FEDERAL REGULATION WHERE THERE IS CONFLICT WITH RESPECT TO… SAFETY v. COMPLIANCE ?

    9. 30 CFR 56.15005 SAFETY BELTS AND LINES SAFETY BELTS AND LINES SHALL BE WORN WHEN PERSONS WORK WHERE THERE IS DANGER OF FALLING: A SECOND PERSON SHALLTEND THE LIFELINE WHEN BINS, TANKS, OR OTHER DANGEROUS AREAS ARE ENTERED.

    10. What’s the problem ? Belts were never designed nor intended for FALL PROTECTION… They were designed and intended only for FALL PREVENTION. Line? 3” mooring line, 3/8” Hemp rope, 1” polypropylene … all lines, yes… “Danger of Falling…” Above grade, 2’, 4’, 6’, 10’, 15’, 30’ … Anchor Point? Doesn’t say…does it?

    11. SO A COMPLIANT PERSON… …who is standing 12’ up on a structure with no handrail system who is wearing a Safety Belt that is tied off on to conduit with an 11’ length of 3/8’ Hemp Rope is actually in compliance … BUT… are they being safe?

    13. A SAFE PERSON HOWEVER… …knows the intent of the law is to protect you from hitting the ground and not have harm caused to their body from the use of the PFAS and therefore wears a Safety Harness, 6’ Lanyard w/ integrated shock absorber, tied off to a 5000# t/s anchor point when ?4’ (or less as other conditions warrant) above ground level.

    14. COMPLIANCE IS NOTHING MORE THAN A REVENUE GENERATOR EXAMPLE 56.14100 (b) – Safety Defects: Examination, Correction & Records 2ND most cited standard for the past 3+ years in a row. One of the most misapplied standards out there. Are you ready ?

    15. (a) Self-propelled mobile equipment to be used during a shift shall be inspected by the equipment operator before being placed in operation on that shift. (b) Defects on any equipment, machinery, and tools that affect safety shall be corrected in a timely manner to prevent the creation of a hazard to persons. (c) When defects make continued operation hazardous to persons, the defective items including self-propelled mobile equipment shall be taken out of service and placed in a designated area posted for that purpose, or a tag or other effective method of marking the defective items shall be used to prohibit further use until the defects are corrected. (d) Defects on self-propelled mobile equipment affecting safety, which are not corrected immediately, shall be reported to and recorded by the mine operator. The records shall be kept at the mine or nearest mine office from the date the defects are recorded, until the defects are corrected. Such records shall be made available for inspection by an authorized representative of the Secretary.

    16. HAS THIS EVER HAPPENED TO YOU? You have a piece of equipment that is not being used. MSHA shows up and directs you to get an operator to fire up that piece of equipment because they want to inspect it. You say to the Inspector “We haven’t run it today and the Reg’s say I have to pre-trip it before I put into operation so just to let you know, if I find something wrong, I’m going to tag it out and we shouldn’t get a citation...O.K.?” How has that worked out for you? Got a citation didn’t you, when that Back-Up Alarm or something else didn’t work… You weren’t given an opportunity to employ the law as it is written were you? It suck’s doesn’t it? Is this really about SAFETY NO…it’s about COMPLIANCE (aka: Revenue Generation) AND…Misapplied Compliance at that!

    18. MSHA HANDBOOK SERIES - U. S. Department of Labor MSHA- Metal and Nonmetal Mine Safety and Health March 2009 Handbook Number: PH09-IV-1 L. Inspection of Mobile Equipment Parked on Ready Lines Many mines have areas where mobile or similar equipment is parked and ready for immediate use. These areas are commonly referred to as “ready lines.” Inspectors must inspect equipment for safety defects which is parked at ready lines or similar areas unless such equipment is tagged or marked out of service. The tag should list the defect(s) and prohibit further use until the defect(s) is corrected. Out of service equipment can also be located in a designated area posted for that purpose. Equipment tagged or marked out of service in these areas should not be inspected. Some mobile equipment can not be moved to a designated area as described above due to defects making it incapable of such a move. Inspectors should not inspect equipment like this if it is tagged or marked out of service and the defect is noted. However, if no tag or marking exists, it should be inspected if it is safe to conduct such.

    19. THIS EQUIPMENT IS CONSIDERED DEFECTIVE UNTIL PROVEN OTHERWISE THROUGH THE APPLICATION OF 30 CFR 56.14100. ONLY AFTER A SUCSESSFUL PRE-TRIP INSPECTION HAS BEEN CONDUCTED WITH NO DEFECTS AFFECTING SAFETY WHICH CREATES HAZARDS TO PERSONS HAS BEEN FOUND, CAN THE EQUIPMENT BE PUT INTO SERVICE. VIOLATION OF THIS COMPANY POLICY WILL RESULT IN DISCIPLINARY ACTIONS TAKEN AGAINST THE OFFENDER.

    20. OR…HAS THIS HAPPENED? Same standard - 56.14100(b) - Defects on any equipment, machinery, and tools that affect safety shall be corrected in a timely manner to prevent the creation of a hazard to persons. MSHA finds a safety latch broken on a come-a-long not in use or maybe in use…(it really doesn’t matter) The inspector issues a citation based on 56.14100(b) Is it legitimate from a Compliance stand point? PROGRAM POLICY MANUAL STATES: 56/57.14100 Safety Defects: Examination, Correction, and Records: This standard applies to all off-road and on-road self-propelled equipment used on mine property, including vehicles such as vans, suburbans, and pick-up trucks that are used at mine sites and remain on mine property…. So…I ask you again…Is this a SAFETY issue? NO…it’s about COMPLIANCE (aka: Revenue Generation)

    21. IF YOU THINK I’M PICKING ON MSHA… You’ve missed my point… We know that our equipment should be in good working order. We know we should inspect ALL equipment prior to using it. We know that we should not be using our equipment when it’s busted. WHY? BECAUSE A SAFE PERSON KNOWS BETTER!

    22. SO…WHO’S THIS “WE” KEMO-SABE? WE KNOW WHAT THE MSH ACT 77 SAYS…OR DO WE? “SEC. 2. Congress declares that-- the first priority and concern of all in the coal or other mining industry must be the health and safety of its most precious resource--the miner; … AND (e) the operators of such mines with the assistance of the miners have the primary responsibility to prevent the existence of such conditions and practices in such mines; …AND (g) it is the purpose of this Act (2) to require that each operator of a coal or other mine and every miner in such mine comply with such standards”

    25. Understanding positive thinking and self-talk Self-talk is the endless stream of thoughts that run through your head every day; some positive …some negative. Self-talk comes from logic and reason. Other self-talk may arise from misconceptions that you create because of lack of information. If the thoughts that run through your head are mostly negative, your outlook on life is likely pessimistic. If your thoughts are mostly positive, you're likely an optimist — someone who practices positive thinking.

    26. How positive thinking gives way to negative thinking But what if your self-talk is mainly negative? That doesn't mean you're doomed to an unhappy life. Negative self-talk just means that your own misperceptions, lack of information and distorted ideas have overpowered your capacity for logic and reason.

    27. Some common forms of negative and irrational self-talk include Filtering - You magnify the negative aspects of a situation and filter out all of the positive ones Personalizing - When something bad occurs, you automatically blame someone else. Catastrophizing - You automatically anticipate the worst. Polarizing - You see things only as either good or bad, black or white.

    28. Periodically during the day, stop and evaluate what you're thinking. If you find that your thoughts are mainly negative, try to find a way to put a positive spin on them. I've never done it before It's too complicated I don't have the resources There's not enough time There's no way it will work No one bothers to communicate with me It's an opportunity to learn something new I'll tackle it from a different angle Necessity is the mother of invention Let's re-evaluate some priorities I can make it work I'll see if I can open the channels of communication

    29. 10 STEPS TO BEING POSITIVE You are responsible for your own happiness. Your attitude should be neither dependant nor conditional on the achievement of a goal. You're the only pilot flying this plane, so you have to make a choice: be happy or be miserable. Somebody loves who you are and what you're doing. No matter how bad things go on the job, someone loves what you're doing. We have to think beyond work-to our families who depend on us and our children who wait for us to come home.

    30. 10 STEPS TO BEING POSITIVE There's a big difference between logic and conviction. People are swayed more by the convictions in your heart than the logic in your brain. "We all need a level of conviction in our work in safety & If you don't have conviction in the work you do; you need to quit before you hurt someone.“ You will be tested. Our convictions are constantly being tested. We know that safety is more than just a manual; it's an attitude. And our attitudes are reflected in our behaviors. Therefore it's important to set a good example.

    31. 10 STEPS TO BEING POSITIVE You are here for a purpose: To get better. The more we serve people, the better service gets and the better life gets. Sound simple? It is. You will never be given more than you can handle. And you can handle everything you're given. You've made it this far, haven't you? What makes you think you can't handle what's coming? "The moment you agree with someone else's (negative) assessment of you, you've been beaten."

    32. 10 STEPS TO BEING POSITIVE You are on this earth for a specific time frame. But we don't know how long that is. So take advantage of this gift and get on with what needs doing. Your actions will determine your outcome. Doing nothing gets you more of the same: nothing. If you want different results, you need to do something different.

    33. 10 STEPS TO BEING POSITIVE You get what you give. If you want a good day at work, give someone else a good day. "The more you give in safety, the more you will get back.“ Attitude Life really comes down to attitude. If you have a negative attitude, you'll have a negative outlook on life. So why wouldn't we all choose to have a positive attitude? Go figure.

PROVIDING THE NECESSARY MEANS BY WHICH TO SAFELY PERFORM ASSIGNED TASKS…TOOLS, TRAINING, TIME & PROPER MOTIVATION. IMMEDIATELY CORRECTING UNSAFE BEHAVIORS / CONDITIONS AS OBSERVED OR OTHERWISE HAVE KNOWLEDGE OF.

    39. ALL HOURLY EMPLOYEES MUST: ASSURE FOR THE SAFETY, HEALTH & WELFARE OF THEMSELVES, THEIR FAMILIES AND THEIR CO-WORKERS BY: FOLLOWING ALL APPLICABLE FEDERAL SAFETY REGULATIONS & COMPANY POLICIES. UTILIZING THE NECESSARY MEANS BY WHICH TO SAFELY PERFORM ASSIGNED TASKS…TOOLS, TRAINING, TIME & PROPER MOTIVATION. IMMEDIATELY CORRECTING UNSAFE BEHAVIORS / CONDITIONS AS OBSERVED OR OTHERWISE HAVE KNOWLEDGE OF.

    40. THE MINER’S PLEDGE SET THE EXAMPLE FOR OTHERS TO FOLLOW. NOT LOOK THE OTHER WAY WHEN AN UNSAFE PRACTICE OR CONDITION EXISTS. STRIVE TO ACHIEVE A SAFE, PRODUCTIVE & EFFICIENT ATMOSPHERE WITHOUT CREATEING A SENSE OF EXTREME COMPETITION. NOT HURRY TO OVERCOME MY LACK OF PLANNING AND PREPARATION. NOT SACRIFICE SAFETY TO EXPIDITE A TASK. PRACTICE GOOD HOUSEKEEPING WHEN PERFORMING EACH TASK I AM ASSIGNED. NOT PERFORM UNSAFE ACTS, CREATE UNSAFE CONDITIONS OR DISREGARD SOUND SAFETY PRACTICES OR PROCEDURES NOT ALLOW PEER PRESURE TO COMPROMISE MY SAFETY PRINCIPLES.
