Directorate for Water of Montenegro The geografical position of Montenegro has specificinfluence on rainfall regime, wit precipitation on some locations among the highest in Europe (over 4500 mm of precipitate annually) The lack of surface water and abundance of ground water On relatively small distance we have both- richness and lack of water

  3. Directorate for Water of Montenegro Surface and ground waters from Montenegro territory belong to Black Sea basin and Adriatic Sea basin The significant part of these waters flows into Adriatic Sea or Black Sea through neighboring countries

  4. Directorate for Water of Montenegro The state is responsible for establishing laws, policy, institutions and procedure at interior area, which will enable adequate regulation and their conducting: for exterior area, the state is responsible for establishing cooperation with neighboring countries, and countries in the region when needed

Directorate for Water of Montenegro Now is the moment when Montenegro works intensively on harmonization and upgrading its own legislative, as a prerequisite for necessary accession not only to legal and institutional system but to the practices of the Union members as well.One of the important steps on this way is recently adopted Water Law.

  6. Directorate for Water of Montenegro By adopting now Water Law (May, 2007) which is harmonized with the WFD, former Law on Waters from 1995 was repealed. Directorate for Water of Montenegro The Law governs the legal status and integrated management of waters, water land and coastal land and water facilities, terms and methods for carrying out water related activities and other issues of relevance for management of waters and water property. Means for financing water management activities shall be provided in compliance with a separate law, that is being drafted.

Directorate for Water of Montenegro Water management comprises the set of activities, decisions and measures in relevant area: Provision of waters with long-term water quality and water source protection; Protection of waters against pollution; Regulation of waters and water currents; Protection from waters.

  9. Directorate for Water of Montenegro The Law, for the first time, defines water body as separately observed and spatially defined element of surface and ground waters, which will represent, due to its importance and role set out in terms of this Law, irreplaceable element of almost all forthcoming legislation-planning and other activities in the water area.

  10. Directorate for Water of Montenegro As a basic unit for water management, Water Law predicts that the Government of Montenegro for water district adopts, besides the water Master Plan, other important plan – water management plan for water district of river basin, at the proposal of Ministry. The competent authority of the State shall prepare Water Management Plans for water areas and river basins.

  11. Directorate for Water of Montenegro From the point of view of water management, of the particular importance is classification made in terms of importance or cross border impact on water important for State of Montenegro and those of local importance. In the conformity with this classification, management of water and water lands is planned in a manner that the governmental authority shall be responsible for waters important for the state whereas local authorities are responsible for local level waters

  12. Directorate for Water of Montenegro The Government, being the executive power holder, has many competences laid down by this law, setting the water policy. In that view, the Government is in charge of adoption of key planning documents, the key decisions, normative documents and establishing or appointing of executive organs and bodies.

  13. Directorate for Water of Montenegro The Government is followed by the Ministry in charge of water activities, which is competent for proposing and implementing water-related policies, and in cases when thus provided for by the law, the Ministry also implements some planning documents, adopts normative documents within its authority and carries out administrative supervisions, inspections and control.

  14. Directorate for Water of Montenegro The key executive authority in this field is the competent administration authority, which has already been established –The Directorate for Water. The Law also includes provisions on responsibilities of local government bodies for public water supply and sewage system.

  15. Directorate for Water of Montenegro With adoption of new Water Law, Montenegro’s legislation of relevance for water management shall be harmonized with the EU Acquis Communautaire.
