  2. What is HIPAA violation? It is the failure to fulfil any aspect of HIPAA standards and provisions stated in 45 CFR Parts 160, 162, and 164.

  3. Accidental breach of HIPAA: • A healthcare employee accidentally seeing a patient's data • An e-mail or fax containing PHI of person sent to another person • Accidental exposure of PHI

  4. Incidental breach of HIPAA: • Inadvertent disclosure of patient data • The provider should have made reasonable attempts to limit the information getting disclosed

  5. What if you identify a HIPAA violation? The business should notify the U.S. Department of Health & Human Services (HHS) and the concerned individuals.

  6. Penalties for HIPAA violation: Civil penalties for HIPAA violations result in fines, and criminal penalties end up in jail terms. Certain breaches may result in both civil penalties and criminal charges.
