DeclarationofBlacklistedforBid Thegovernmentcanblacklistcompaniesforunethicalbehavior,butmustdoso fairly,givingthemachancetorespond.Decisionsmustfollowprinciplesof fairnessandcanbereviewedbycourtstoensurethey’renotarbitraryorunjust Acompanycanbeblacklistedforreasonssuchasbribery,fraud,corruption, unauthorizeduseofgovernmentmaterials,securityconcerns,misbehavior, bid rigging,failuretomeetgoals,non-compliancewithqualitystandards,breachof contractterms,andsubmittingfalsifieddocuments.Thegovernment’spowerto blacklistmustbeexercisedfairlyandwithoutarbitrarinesstoensurefairnessand equality. Governmentundertakingsmustfollowspecificstepsbeforeblacklistingacontractorto protecttheirrights,asmandatedbytheSupremeCourt: 1.NaturalJusticeandAudiAlteramPartem: Contractorsmust begiven a“showcause”letterandan opportunitytobe heard.This principleensuresfairnessandisrootedinArticles14and21oftheIndian Constitution. Thereasonsfor blacklistingmust beclearlystated,andifthe contractor isn’tgivena chancetopresenttheircase,itviolatesnatural justice. 1.Doctrineof Proportionality: Theblacklisting processandthe punishmentmustbeproportionalandnot arbitrary, inaccordancewithArticle14,ensuringfairnessandjustactionsbythe state.
