Supreme Court to hear PIL regarding menstrual pain leaves on February 24. 15 February, 2023 Today, the Supreme Court bench agreed to hear a PIL filed by Shailendra Mani Tripathi seeking menstrual pain leave for female workers and students across India on February 24, 2023. The Public Interest Litigation (PIL) was presented before the Supreme Court bench headed by the Hon’ble Chief Justice of India DY Chandrachud. The petition mentioned by Advocate Vishal Tiwari highlighted that the government, society, and other stakeholders have largely disregarded menstrual periods whereas there are some organizations and State governments that pay attention to them. The petitioner in his PIL had specifically mentioned the names of companies that provide paid period leave including Swiggy, Zomato, Mazter, ARC, Gozoop, Ivipanan, Byju’s, Mathrubhumi, Industry, and FlyMyBiz. In addition to this, the petition also illustrated the effective implementation of Section 14 of the Maternity Benefit Act involving the appointment of inspectors. Moreover, it also highlighted that various countries such as China, Japan, Indonesia, Spain, the United Kingdom, Zambia, Taiwan, Wales, and South Korea are providing menstrual pain leaves to their female citizens. Also, he contended that denial of period leave or menstrual pain leave is a violation of women’s right to equality under Article 14 of the Constitution.
