  1. FREELAW SUPREME COURT UPDATES Supreme Court bench disapproves another bench assigning a case; cases are to be assigned only by the CJI

  2. On March 13, 2023, the Supreme Court of India observed the disapproval of, one bench assigning a case to the other bench. In the order delivered, the top Court highlighted the fact that it is an established practice of the Court that all the cases are to be assigned only by the Chief Justice of India. The main issue here was the order passed by a bench on February 27, comprising Justices CT Ravikumar and MR Shah directing to list of the case before the bench comprising Justice BR Gavai.   3. Advocate Prashant Bhushan (appearing for the victims) today urged to the Supreme Court bench that the trial in the Lakhimpur Kheri case is slow-paced. The bench opposed this statement today while hearing the matter and opined that the case is going on “not slow-paced”. Lakhimpur Kheri case is the one in which Ashish Mishra, son of Union Minister Ajay Mishra, was accused of the death of four farmers involved in a protest. On January 25, 2023, an interim order was passed granting interim bail of 8 weeks to Ashish Mishra as well as the other four accused. Today, the bench directed that this interim order will continue to operate.
