  2. Objectives • Considerations of federal law governing of state cross-border agreements • Summarize existing Canadian/State agreements • Examine the Pacific Northwest Emergency Management Arrangement

  3. Federal Law • US Constitution, Article 1 section10 • Clause 1: “no state shall enter into any Treaty, Alliance or Confederation.” • Clause 3: “no state shall, without the consent of the congress,… enter into any Agreement or Compact with another state, or with a foreign power.”

  4. Existing Cross-Border Agreements • Agreement between Eastern Canadian Provinces and New England States • Great Lakes Forest Fire Protection Agreement • Cross Border Contingency Plan between Ontario and New York • Pacific Northwest Emergency Management Arrangement
