What are bonds mentioned in construction contract documents? Bonds are a form of insurance for projects. The three common types of bonds are bid bonds (a guarantee that the bid will be honored by the contractor and if not, the bond will cover the cost of rebidding); a payment bond (a guarantee that the contractor has paid the subcontractors); and a performance bond (a guarantee that the contractor will perform to the terms of the contract). What is a contract? An agreement with specific terms between two or more persons or entities in which there is a promise to do something in return for a valuable benefit known as consideration What factual elements must a contract contain? An offer, an acceptance of the offer, a promise to perform, a valuable consideration, a time commitment, terms and conditions of performance, and the actual performance of the basis of the contract What is a standard of care? It is that level of service ordinarily provided by other competent members of the construction profession, providing similar services in the same locale and under the same or similar circumstances. What are three common forms of dispute resolution? Litigation, arbitration, and mediation What is the purpose of plans and specifications? Plans and specifications are used in a supplementary and complementary role to convey the design and achieve the expected construction result. In the case of a conflict between the plans and the specifications, which prevails? If there is a conflict or disparity between plans and specifications, neither prevails. This becomes an opportunity and obligation to seek clarification by the design professional of the intent of the plans and specifications. Get such clarifications in writing! What are codes and standards? Codes and standards are the legal documents, in addition to the contract documents, that set forth the minimum material, process, or performance standards expected for the construction. If there is a conflict between a contract provision and a code requirement, which prevails on a construction project?
