What Is a Cargo Claim or Freight Claim? www.jaypackersmover.com
Freight Insurance vs Freight Liability • Unfortunately, a carrier cannot purchase a standard freight insurance policy and be entirely secure. • Freight insurance does not cover all losses for which a carrier may be held liable under the Carmack Amendment or under common law. • With regard to insurance, it is critical that anyone in charge of shipping understands the scope of the carrier's legal duty for freight loss as well as the coverage given by the carrier's insurance.
The Carmack Amendment, which established a consistent national standard of liability for freight loss and damage and was expanded to include motor carriers in 1935, is the foundation of freight liability. • A carrier is liable for any cargo loss, damage, or delay that is not caused by one of the five recognized carrier defenses: an act of God, an act of a public adversary, an act of the shipper, an act of a public authority, or the intrinsic nature or vice of the goods themselves. • In the absence of any of these circumstances, the carrier is liable for the shipment's actual loss or damage. • Every planned freight shipment has some type of limited liability coverage. • Shipper error, rather than carrier error, can sometimes cause damage or loss. If the damage is the consequence of inadequate packaging, incorrect loading, or weather-related issues, the carrier is not responsible for paying for repairs. Additional freight insurance would be beneficial in this circumstance.
Freight Claim Types • Damage The "damage" section comprises the most common freight claims, which, as the name implies, indicate that the cargo is damaged when it arrives at its destination. To fall into this category, it must be plainly damaged upon arrival, and the damage must be indicated on the proof of delivery. • Loss A "loss" is another common freight claim classification. This happens when cargo is reported as being picked up at its origin but never delivered to its destination. This can be demonstrated by a legal original bill of lading and no formal signed proof of delivery. • Shortage A shortage happens when less freight arrives at the destination than was anticipated and listed on the BOL. Many things can go wrong, including anything falling off the original pallet. If your freight claim can be recognized and documented at the moment of delivery, with the driver's signature serving as verification, it will be considerably easier to file.
The one-year deadline for commencing a lawsuit over cargo claims may be extended by mutual consent of the parties. • In India, the top limit has been raised to 666.67 SDRs per package or 2 SDRs per kilogram of missing or damaged goods, whichever is greater. • Under present Indian legislation, both the ship and the carrier are ineligible to profit from the package limits. That is, if it can be proven that the carrier acted knowingly, recklessly, or with the knowledge that damage was likely to occur. • Cargo Claims in India
