  3. Recommendations • The International Working Group recommended: • Option 8: “A code based on the harmonized FAR/JAR developed by FAA and JAA and adopted by ICAO,” as the optimal solution of the 15 options evaluated.

  4. Recommendations • Option 8 should be pursued through a phased approach • Phase I: Promote Current FAR/JAR Harmonization Work Program. • Phase II: Develop concept of having the Harmonized FAR/JAR recognized under the ICAO umbrella. • Phase III: Seek ICAO Agreement and Implement.

  5. Recommendations • An individual or group should be specifically tasked to undertake and monitor the implementation of the recommended option.

  6. Aviation Register Approach • Supports • a Global Design Code and • Single Worldwide Certification • Steps • identify common requirements between all independently developed standards • adopt those standards as a core Global Code under the ICAO umbrella • minimize National differences

  7. Summary of Comments The comments were diverse, they included: • Put the “Code” activity on the “Back Burner” • Support of continued work toward a “Single or Globally Harmonized” code • Industry has found practical means to overcome the lack of a single code

  8. Summary of Comments • Caution on expenditure of limited resources • Prioritization of activities (EASA, Harmonization) • Current system works • Need for a definition of the ICAO mechanism • Level of “Bindingness” • Sovereignty

  9. Summary of Comments • Need for a global listing of Additional National Requirements • ANR are expensive need to reduce or eliminate

Analysis of Workshop Feedback • The comments did not contradict the phased approach toward Option 8. • The phased approach as proposed by the International Working Group takes into account the concerns expressed by the Workshop participants due to the checks and balances that are built into the option.

Analysis of Workshop Feedback • The concerns regarding resource expenditure, prioritization and level of bindingness are not a factor until Phase II • Based on the comments received the co-chairs conclude that the next step should be to pursue Option 7 - A Harmonized FAR/JAR adopted on a voluntary basis.

  12. Proposed Next Steps • Pursue a Harmonized FAR/JAR adopted on a voluntary basis • Increase awareness of the status of the FAR/JAR Harmonization Work Program (Note: “Harmonization is used in the broadest sense to include joint rulemaking)

  13. Proposed Next Steps • Encourage States that have not already done so to adopt the FAR or JAR into National Law • Encourage minimization of National Variants • Complete harmonization under FAA/JAA Work Program - aim for fewer differences.

  14. Proposed Next Steps • Give further consideration of inviting other authorities/interested parties to participate in the development of the Harmonized FAR/JAR under FAA and JAA leadership • Assess level of implementation at a “to be determined” future date
