How to do business with the NHS in Yorkshire and the Humber Caroline Carter-Smith, CPC Project Manager
The Rules - High Value • The NHS, like other public sector organisations and government departments, must meet the requirements of EU Public Procurement Directives which ensure open and fair competition • Under these directives, we must advertise all* contracts with a total value over £101,323 (for supplies and services) or £3,927,260 (for works) in the Supplement to the Official Journal of the European Union (OJEU) • These adverts enable suppliers to express an interest in the majority of our national contracts, as well as many regional and local contracts • * with some exceptions – Part B services!
The Rules - Lower Value • EU Public Procurement Principles • UK Competition Law • Individual Trusts also have their own rules: • Standing Financial Instructions • Standing Orders
Competition Law • UK Procurement policy • When contract not required to be let under the EU rules, UK Procurement Policy applies. • Requires that value for money sought in all public procurement • This to be achieved through competition unless compelling grounds to the contrary. • Even when EU Rules do not apply, EC Treaty principles (non-discrimination, equal treatment, transparency, mutual recognition and proportionality) still apply. • Some degree of advertising – commensurate with the scale of the contract – is likely to be necessary with most contracts to demonstrate transparency.
E-tendering for lower value opportunities – www.cpcplus.co.uk
CPC Plus • www.cpcplus.nhs.uk or www.cpcplus.co.uk • Simple for NHS organisations in Y&H to obtain low value (sub- OJEU) quotes/ tenders • Easier for Trusts to connect with suppliers • Better value for Trusts – competition in marketplace • Initially print, communications, marketing, office furniture, consultancy • Obtaining feedback from stakeholder Trusts around expanding category range • Free for suppliers until 31st May 2010 • Also B2B opportunities
E-tendering for health & social care – www.supply2health.nhs.uk
Tendering Process - pre-qualification • Sid4health – www.sid4health.nhs.uk • Single source of data on suppliers linked to Dun & Bradstreet (D&B) DUNS® number • Shared service among all purchasing organisations • Free of charge to all suppliers & NHS users • Does not mean suppliers are approved • Not mandated, but will only deliver benefit if it gets used! • Can replace / severely reduce size of PQQ • Bravo currently working on integration of sid4health into e-tendering system
NHS/ CPC Opportunities – A Summary • Try to build relationships within relevant Trusts • Visit Trust websites • Find a convenient way to access OJEU high value tender opportunities • I recommend you register on the following websites (if applicable): • www.cpcplus.nhs.uk • www.sid4health.nhs.uk • www.yhcpc.bravosolution.co.uk • www.supply2health.nhs.uk
