Once established an ownership interest in an Australian business, the applicant can apply for permanent residence through the Business Innovation & Investment (Residence) Subclass 888 visa. A 2-year extension is possible once the applicant has held the subclass 188 visa for 3 years, giving 7 years from the date of grant of the original Visa. Subclass 188A Visa Requirements Visa Period • Be nominated by an Australian State or Territory government agency. 5 years • For 2 of the last 4 years, you must have had an ownership stake in 1 or 2 businesses that had at least AUD750,000 turnover in each of those 2 years. After maintaining the visa for 3 years, the applicant can apply for permanent residence through the Business Innovation & Investment (Residence) Subclass 888 visa. • Have at least 3 years’ experience (cumulative) of direct involvement in managing one or more qualifying businesses or eligible investments. Subclass 188B Visa Requirements • Be nominated by an Australian State or Territory government agency. • You and your partner combined must have total net business and personal assets of at least AUD2,500,000 for the last 2 fiscal years. • Under 55 years of age, unless the nominating state or territory certifies that you will make an exceptional economic benefit. • Score at least 65 on the points test. Requirements to Permanent Visa Subclass 888B Visa • Make “complying investment” of at least AUD 2.5 million and has genuine intention to hold investment for the whole visa period. A “complying investment” for the purposes of the 188B visa must be made up of: • Be nominated by an Australian State or Territory government agency. • Maintained the AUD2,500,000 complying investment for the whole visa period. • At least AUD500,000 in venture capital and growth private equity funds which invest in start-ups and small private companies. • Resided in Australia for at least 2 years holding a subclass 188B visa in the 3 years prior to the application. • At least AUD750,000 in approved managed funds investing in emerging companies listed on the Australian Stock Exchange. Visa Period 5 years • A ‘balancing investment’ of at least AUD1,250,000 in managed funds that may invest in a range of assets, including ASX-listed companies, Australian corporate bonds or notes, annuities and commercial real estate. After maintaining the visa for 3 years, the applicant can apply for permanent residence through the Business Innovation & Investment (Residence) Subclass 888 visa. Subclass 188C Visa Requirements Advantages of the Subclass 188C Visa • Be nominated by an Australian State or Territory government agency. • There is no Innovation Points Test requirement for visa application. • You and your partner combined must have total net business and personal assets of at least AUD 5 million. • There are no English language requirements. • There are no age requirements. • Make “complying investment” of at least AUD 5 million and has genuine intention to hold investment for the whole visa period. While there is no specific time period that guarantees a smoother process to migration, there are a few key things to consider. What happens if I do not apply for a visa within 60 days after receiving a letter from the Department of Home Affairs? The invitation from the Department of Home Affairs has 60-day validity duration. Within this time frame, the application must be submitted, or else your EOI will lapse, and you will not be regarded for the visa. Am I required to use a Migration Agent or Lawyer to apply? All business visas will have to go through the process of obtaining State Nomination and Expression of Interest (EOI) invitation. Your migration lawyer will represent you to obtain those during the process of your business visa application. I am the one who apply for this visa, yet I want to bring my whole family. What should I do? When you make a visa application, you can add or include family members in a combined application for the same visa. Generally, a person is a member of your family unit if he or she is your partner (spouse or de facto partner) or your child or stepchild. Is it possible to travel to Australia while my migration application is being processed? Yes. However, you will need to obtain the appropriate visa (e.g. a visitor visa, ETA) for your visit.
