Medical Marijuana Registry Background Amendment 20 passed November 2000 Incorporated into the Colorado Constitution under Section 14, Article XVIII CDPHE administering program 13 other states have similar laws/programs Alaska, California, Hawaii, Maine, Michigan, Montana, Nevada, New Jersey, New Mexico, Oregon, Rhode Island, Vermont & Washington

Medical Marijuana Registry Key Elements Eligible Conditions Cancer, glaucoma, HIV/AIDS, cachexia, severe pain, severe nausea Seizures, including those that are characteristic of epilepsy Persistent muscle spasms, including those that are characteristic of multiple sclerosis Adding Conditions Anyone may petition the Registry to add a condition Condition must be chronic, debilitating, and able to be specifically diagnosed Scientific evidence that treatment with marijuana may have a beneficial effect

    4. Medical Marijuana Registry Application Process Patient completes application Physician confirms condition Cost: $90 per year Registry verifies physician licensure Card must be renewed each year All information maintained in a confidential database

Medical Marijuana Registry Key Elements Documentation of condition Bona fide patient/physician relationship Physician, MD or DO, in good standing, licensed to practice medicine in the state of Colorado Amount of marijuana allowed 2 ounces of usable marijuana Up to 6 plants, with 3 or fewer being flowering, mature plants Affirmative defense allowed for excess amounts

Medical Marijuana Registry Legal Provisions Patient - Possession of a valid registry card - Compliance with provisions of state law - Affirmative defense allowed if not in possession of ID card - No protections under federal law Physician - Advising patient of possible risks/benefits - Providing written documentation of qualifying condition - Recommendations do not violate federal law

Medical Marijuana Registry Legal Provisions Prohibitions - Using in a place open to or in view of public - Using in any way that endangers the health of others - Fraudulent representation of a medical condition - Fraudulent use, theft, production or tampering - Breach of confidentiality of the Registry

    8. Medical Marijuana Registry Assisted Living, Nursing Home and Hospice Care Issues Who is responsible for bringing marijuana to the center? Who is responsible for accepting the marijuana at the center? Where will medicine be stored? Who has access to the medicine? Who can assist the patient with their medicine? Where can the patient use their medicine?

Medical Marijuana Registry Program to Date September 30, 2009 19,691 new applications received 24 applications denied, 21 revoked, 236 patients deceased, 1,631 cards have expired Average 4 month turn around time to issue ID cards Four petitions to add conditions received and denied-Anxiety, Asthma, Bi-Polar Disorder & Parkinson’s Disease

Medical Marijuana Registry Program Statistics 73% of approved applicants are male Average age is 40 57% of patients reside in Denver-Metro/Boulder area Over 800 different physicians have signed for patients in Colorado Severe pain accounts for 90% of all reported conditions, with muscle spasms at 30% 67% of patients have designated a caregiver

    12. DISPENSARIES The Colorado Medical Marijuana amendment, statutes and regulations are silent on the issue of dispensaries. The Registry is aware that a number of such businesses have been established across the state, we do not have a formal relationship with them. Please be aware: The Registry does not license dispensaries. The Registry does not have a list of dispensaries. There are no regulations regarding dispensaries. The Registry is unable to assist with complaints regarding dispensaries. The Registry has no information on how to establish/operate a dispensary. There may be local ordinances that might impact the operation of a dispensary. Please contact local authorities for specific information.
